Comcast Late Fee Class Action Settlement
By Matt O’Donnell

ComcastComcast customers in Oregon who were charged late fees and/or administrative fees for having delinquent accounts may be able to entitled to an account credit or a payment from a class action lawsuit settlement with Comcast.

The proposed Oregon Comcast settlement will resolve a class action lawsuit, entitled Hochstetler et al. v. Comcast of California/Colorado/Florida/Oregon, Inc., et al., that claims late fees and/or administrative fees charged by Comcast to delinquent cable television subscribers between July 15, 2003 and November 22, 2010 failed to comply with the requirements of Oregon law.

If you are a current or former Comcast cable television subscriber in Oregon who paid a late fee within those date ranges, you are a member of the Oregon Comcast late fee settlement class and may be entitled to the following benefits:

Account Credit (for current subscribers): Any current Oregon Comcast subscriber who paid one or more late fees during the Class Period will be entitled to receive a credit towards their account of $16 per late fee upon submitting a valid claim form. You will not need to submit proof of these payments unless you’re claiming over two late fees, in which case you’ll need to either submit proof of payment for each additional late fee or affirm under oath before a notary public the number of late fees paid.

Cash Refund (for former subscribers): Any former Oregon Comcast subscriber who paid one or more late fees during the Class Period will be entitled to receive a cash payment of $16 per late fee upon submitting a valid claim form. You will not need to submit proof of these payments unless you’re claiming over two late fees, in which case you’ll need to either submit proof of payment for each additional late fee or affirm under oath before a notary public the number of late fees paid.

In order to receive any of these benefits from the Comcast late fee class action settlement, you must submit a valid claim form and any required proof of payment of late fees postmarked no later than July 1, 2011. If you wish to opt out of the settlement, you must submit your request by March 27, 2011.

You can download a claim form and find more information about your rights in the Oregon Comcast Late Fee Class Action Lawsuit Settlement on the Settlement Administrator’s website at www.OregonLateFeeSettlement.com.
