lawsuit settlementPlaintiffs James and Gwenda R. have joined the pending testosterone replacement therapy multidistrict litigation (MDL). The husband and wife joined the MDL, which consolidates similar lawsuits in one location under a single presiding judge, after James allegedly suffered injuries from using the testosterone medication AndroGel.

James and Gwenda’s testosterone lawsuit states that James began using AndroGel as prescribed on Feb. 11, 2012. He stopped using the product three months later on May 25, 2012. Despite discontinuing use of the gel, James suffered from a bilateral pulmonary embolism and deep vein thrombosis in June 2012.

AndroGel is made by AbbVie, a subsidiary of Abbott Laboratories. The plaintiffs are suing AbbVie Products LLC, AbbVie Inc. and Abbot Laboratories as part of their claim. Claims for this testosterone lawsuit include strict liability for design defects, failure to warn, negligence, negligent misrepresentation, breach of express and implied warranty, and fraud.

James and Glenda’s AndroGel Testosterone Lawsuit is Case No. 1:15-cv-07000, filed under the Testosterone Product MDL In re: Testosterone Replacement Therapy Products Liability Litigation, MDL No. 2545, in the U.S. District Court for the Northern District of Illinois.

Testosterone Replacement Therapy and Side Effects

Testosterone therapy is used to treat hypogonadism in males, where the pituitary glands or testicles do not make enough testosterone and males have unwanted conditions such as sexual dysfunction, lower bone and muscle mass, reduced energy and low mood.

Testosterone replacement therapy is also known as Low-T therapy, or simply testosterone therapy. It involves giving men synthetic testosterone hormones, commonly in the form of a testosterone injection, testosterone cream, or testosterone gel. Some men use testosterone patches and oral medications, as well as subcutaneous implants.

While some men experience only a positive response to the hormone replacement, others are not so lucky. Common testosterone side effects include:

  • Breast enlargement
  • Fluid retention
  • Mood swings or increased aggression
  • Reduction in testicle size
  • Skin changes, such as acne or oily skin
  • Sleep apnea worsening
  • Urinary frequency, caused by stimulation of the prostate tissue

More rare, but serious side effects include:

  • Deep vein thrombosis (a blood clot that forms in a deep vein of the body, most commonly in the legs. Clots can break loose and cause pulmonary embolism.)
  • Increased risk of heart attack
  • Pulmonary embolism (a sudden blockage of the artery in the lung, usually caused by a blood clot. It can cause permanent lung damage and damage to other organs resulting from low oxygen.)
  • Stroke, mini stroke and blood clots
