Anthem Wage Theft Class Action Lawsuit Overview:

  • Who: A former employee of The Anthem Companies is suing her employer, alleging wage theft.
  • Why: The employee says she and others were not paid for overtime.
  • Where: The lawsuit was filed in Georgia federal court.

Health insurance provider Anthem underpays its workers by denying them overtime with some working 60-hour weeks with no additional pay, a new class action lawsuit alleges.

Former Anthem Employee Deon Baker filed the class action lawsuit against the company Nov. 29 in a Georgia federal court, alleging violations of the Fair Labor Standards Act.

“Anthem operated a willful scheme to deprive Plaintiff and others similarly situated of overtime compensation,” the lawsuit says. 

According to the class action lawsuit, Baker and others on salary routinely work more than 40 hours in a workweek but are not paid an overtime premium for their overtime hours. Baker worked at Anthem from 2015 to 2020. 

“For example, between May 11, 2020, and May 17, 2020, Plaintiff estimates that she worked approximately 60 hours and did not receive overtime pay for her overtime hours,” the lawsuit alleges.

Baker says she complained about the long hours to her manager. However, the manager responded that she could not change the workload because the company would not be hiring additional workers.

Nurses Were Treated As Exempt From Overtime Laws, Class Action Alleges

Baker is looking to represent any Anthem employees in Georgia who work as Medical Management Nurses, Utilization Management Nurses, Utilization Review Nurses, Nurse Reviewers, Nurse Reviewer Associates or other similar positions who were paid a salary and treated as exempt from overtime laws.

She’s seeking certification of the class action, back pay, damages, fees, costs and a jury trial. 

Meanwhile, In September, members of Anthem Blue Cross’s Emloyee Retirement Income Security Act health plan who suffered from eating disorders and sued the company over alleged violations of ERISA in their coverage reached a $400,000 settlement with the company.
