An unpaid overtime class action lawsuit was filed against Jamba Juice Co. in California Superior Court by two Jamba Juice shift leaders who allege the popular smoothie chain did not provide full wages or meal and rest breaks to them and other workers.
Lead plaintiffs Rosa A. and Jessica G. filed this unpaid overtime class action lawsuit last week claiming Jamba Juice made a regular practice of having shift leaders clock out during meal breaks and subsequently forcing them to work off the clock. Some duties the two allege they were made to perform during their meal breaks and rest periods include using their own cars to drive to a local bank and deposit money on behalf of Jamba Juice.
In their Jamba Juice class action lawsuit, they allege:
“Those meal periods were not waived by mutual consent of the defendants and plaintiffs. Defendants required plaintiffs to ‘clock out’ for meal periods and keep working ‘off the clock.’ There is no applicable exemption that would permit defendants to fail or to refuse to provide plaintiffs with the required meal periods.”
Rosa and Jessica allege they and other similarly situated Jamba Juice employees were never able to take their 10-minute rest breaks or their 30-minute meal breaks every four hours as required by California labor laws.
The pair filed this unpaid overtime class action lawsuit on behalf of themselves, as well as a Class of “Persons employed by Jamba Juice Co. as shift leaders within the State of California, at any time during the period beginning four (4) years prior to the commencement of this action, who were paid by the hour.” The plaintiffs are also seeking to certify a subclass of shift leaders employed during the last three years who were paid by the hour and were later fired or quit their job at Jamba Juice.
In addition to claims of neglecting to provide meal and rest breaks to shift leaders, the plaintiffs have also made additional allegations against Jamba Juice in this unpaid overtime class action lawsuit, including unfair business practices, failure to pay minimum wage, and failure to maintain adequate records among other business claims.
The plaintiffs are seeking full compensation for the unpaid wages for the time worked off shift, as well as payment of interest and attorney’s fees. The plaintiffs are also seeking an injunction that would prevent Jamba from continuing these unfair business practices.
