Pep BoysPep Boys stiffs its mechanics out of overtime and doesn’t pay them for all the hours they work, according to a class action lawsuit filed in California Superior Court.

“Pep Boys engaged in a practice of paying mechanics for hours ‘flagged’ or billed to the customer based on the work performed, rather than paying for all hours the mechanics were on-duty and under the control of their employer,” the class action lawsuit says. As a result, Pep Boys mechanics did not earn minimum wage, regular wages or overtime wages during periods when they were required to clean, prepare their stations, wait for vehicles to repair, and/or perform tasks unrelated to the repair of vehicles, which frequently occurred.

The Pep Boys wage class action lawsuit charges the company with systematically violating California wage and hour laws by:

– requiring non-exempt mechanic employees to work more than 8 hours per day without paying proper overtime compensation;
– failing to pay these employees the mandatory minimum wage for each hour worked;
– failing to compensate these employees for hand tools and equipment used or alternatively pay double minimum wage for each hour worked;
– failing to pay all wages due and owing when an employee quits or was terminated; and
– failing to maintain accurate itemized records.

The Pep Boys wage class action lawsuit is brought on behalf of all current and former hourly, non-exempt mechanics employed by Pep Boys in California within the last four years. It is seeking, among other things, to recover unpaid wages and benefits, interest, attorneys’ fees, penalties, and costs and expenses.

    I was working at toyota of hollywood dealer as automotive technician 2017 and i use my own tools my tool box and tools cost over $10,000 they only pay me $13 a hour because i wasn’t not a ASE certified but i am toyota certified i did know about double minimum wage for each hour worked when use your own tools .

    I was hired away from another company to work for pepboys. Was promised training to learn their computer setup for managerial duties. Was assigned to one store but put in another. thus negating the computer setup and training which never happened , let go 5 weeks in due to non involvement by area director who hired and fired me. No one cares of the personal ramifications of the loss in wages to my family. the worst professional actions in my career, don’t work for these no good jerks.

    its the same in arizona we all work hard hours i typically put in 57 hours a week and my avg pay is only 5.50 hr its bs pepboys is still paying for all there lawsuits so we get the crappy pay i have a print out stating i will make 33k this yr but im only gunna make 12k if im lucky HA i made more working at jiffy lube

    I work at pepboys in kentucky and we dont get paid for work paformed untill customer chooses to pic up vehicle which could range from a day to six mounths later, this could make or break us techs on our checks based on how were paid also often were doin warenty work geting paid warenty time on a job that has nothing to do with why customer originaly come in for its like they find every way to make sure were paid minimum wage if posible .we work hard with no rewards . Most techs i know in my distric are behind on their bills some even work two jobs to afford a place toblive and thirs no reason for it. Can kentucky get help too
