A settlement has been reached in the Young America Insurance class action lawsuit, and eligible Class Members may be entitled to compensation.

According to court documents, plaintiffs Leonard and Darlene Chavez filed this motorist insurance class action lawsuit against Young America Insurance Company Inc., alleging the company’s rejection forms for their uninsured/underinsured motorist coverage (or UM/UIM) failed to properly explain a Young American policy holder’s UM/UIM options before they sold Class Members these motorist policies.

Young America Insurance denies all liability in this Young America motorist insurance class action lawsuit, but has agreed to settle the case in order to avoid the uncertainty of going forward in litigation and to avoid further court costs.

Who’s Eligible

According to the Young America Insurance class action settlement website, “You are included in the Settlement if you had an insurance policy issued by Young America in New Mexico after June 24, 2005 and signed a UM/UIM rejection form before February 28, 2013.” Additionally, anyone else covered by your Young America Insurance policy can make a settlement claim, including passengers who were present at the time of the accident.

Potential Award

Varies.

Per the Young America Insurance class action settlement, qualifying Class Members will receive payment of their Young America Insurance benefits for lost wages, medical expenses, and property damage covered under their policy up to thier policy limit multiplied by 150 percent. Most Young America Insurance policy limits run from $25,000 to $50,000 for each occurrence.

For example, if you accrued $5,000 in medical expenses, lost wages, and/or property damage under your Young America Insurance motorist policy, then your payment from the Settlement Fund will be $7,500.

Proof of Purchase

You must mail in a complete Claim Form, postmarked no later than June 20, 2015, in order to take part in this Young America Insurance class action settlement. You may be required to provide medical and/or employment information in order to receive payment of your portion of the motorist insurance settlement.
