A federal judge has granted final approval to a class action settlement over allegations certain car rental agencies located at Nevada airports failed to include an “airport concession recovery fee” in the initial rental rate quote, but itemized it separately in the rental car agreement.
According to the Nevada rental car class action lawsuit, which was filed in 2010, rental car companies that operate on-site at Nevada airports are required to pay a percentage of their gross revenues as a “concession fee,” which the rental car companies pass on to consumers as a surcharged labeled “airport concession recovery fees” (ACRF). The plaintiffs allege the rental car companies failed to include the ACRF in the rental rate quoted to customers, but itemized it separately in the rental agreement. The ACRF typically included an amount that represented about 10 percent of the base rental rate.
In November 2014, Enterprise Leasing Company—West LLC and Vanguard Car Rental USA LLC asked a judge to grant preliminary approval to the Nevada car rental class action settlement. Vanguard operates the National Car Rental and Alamo Rent A Car brands. The companies deny that Class Members are entitled to a refund, but they agreed to settle the class action lawsuit to avoid the time and expense of continued litigation.
Class Members should have received notice of the class action settlement. Each notice contains a unique registration number, which must be registered at the settlement website by July 13, 2015 in order to claim benefits. Upon registering, Class Members will be able to select either a cash or voucher option for recovery.
NOTE: Class Members may have received a notice concerning this litigation back in 2011. A previous settlement had been reached but it was rejected by the Court. Any action you took regarding that settlement are no longer in effect and you should still be eligible to claim benefits for the current Nevada rental car settlement, which received final approval on May 15, 2015.
Who’s Eligible
Class Members include all persons who rented a car from Alamo Rent A Car, National Car Rental, and/or Enterprise at a Nevada airport and were charged an airport concession recovery fee during the relevant Class Period (listed below).
Class Periods:
- Enterprise: June 3, 2004 through Sept. 30, 2009
- Alamo: July 22, 2007 through Sept. 30, 2009
- National: July 22, 2007 through Sept. 30, 2009

Potential Award
A minimum of $5. Class Members who register at the settlement website may choose to receive a check worth 80 percent of the amount they were wrongfully charged, or vouchers that represent at least 100 percent of the amount they were wrongfully charged. The vouchers can be used for free one-day rentals to cover the base rate for any available vehicle up to full size class (taxes, fees and options not included).
According to a post on the settlement website, if there are no appeals, benefits from the Nevada car rental class action settlement will be mailed on or before Oct. 31, 2015.

I got my vouchers in November and plan on using them next week so I don’t believe it’s a scam. I guess I’ll know when I call and make a reservation.
I was told that I would receive a voucher and as af 2/22/16 no voucher, this is begging to look like a nother scam.
I am having the same problems….What can be done? are they all frauds?
put in a claim 5/19/15. I was told I would receive $74 as I elected for the cash settlement. as the case was settled and checks were mailed in November, I have not received mine yet and it is February 5th,2016. called the settlement administrators phone number and message was number could not be reached as dialed. what can be done about this?
