Honda Civic tire wear class action settlement

Honda Civic and Civic Hybrid owners who experienced uneven or rapid rear tire wear have won preliminary approval of a class action settlement over allegations that American Honda Motor Co. knowingly sold and leased the vehicles with a rear suspension defect. Class Members have until Jan. 16, 2014, to claim a number of benefits from the class action settlement.

The Honda Civic tire wear settlement resolves a nearly three-year-old class action lawsuit (Keegan v. American Honda Motor Co.) that alleges Honda knew that its 2006-2007 Honda Civics and 2006-2008 Civic Hybrids had defective rear suspensions through pre-release testing data, early consumer complaints, and other internal sources, yet waited until January 2008 to notify customers. As a result of the alleged suspension defect, the tires on these Civics wore out unevenly or prematurely. There are no safety concerns for owners of these vehicles, but the wear did cause them to pay out-of-pocket expenses to fix.

Honda denies that there was any defect on the Civics but agreed to resolve the litigation by offering to replace Class Members’ worn out tires and the allegedly defective part that caused the wear, and to reimburse owners/lessees who’ve already paid out of pocket for this damage.

Class Members of the Honda Civic tire wear settlement include residents of the United States, Puerto Rico, the U.S. Virgin Islands or Guam who currently or formerly owned/leased a 2006-2007 Honda Civic or a 2006-2008 Honda Civic Hybrid with a VIN that starts with JHMFA3 and ends with a number between 00001 and 10456. You are not included in the class action settlement if you work for Honda or one of its affiliated companies.

Class Members will receive the following class action settlement benefits:

Control Arm Replacement: If you have already paid to replace a control arm on your Civic as a result of premature or uneven tire wear (not because of an accident), you may submit a claim for reimbursement. Honda will reimburse you for parts and labor paid for the control arm replacement. To be eligible for reimbursement, you must provide proof of payment and submit a valid Claim Form before Jan. 16, 2014.

Reimbursement for Tire Wear: If you replaced your tires due to uneven or rapid tire wear, you may submit a claim for reimbursement. Honda will reimburse you on a pro rata basis in accordance with the chart found in the Class Notice.

Detailed claim filing instructions are below.

A Final Fairness Hearing was scheduled for Oct. 28, 2013, but no decision has been entered as of the publish date of this article. Payments will not be made until the settlement is effective. If it is approved, payments will be made to those who submit valid claims approximately 45 days from the deadline for filing claims. If appeals are filed, payment of claims will be delayed.
