California employees who worked 12-hour shifts at a hospital or medical center owned by Integrated Healthcare Holdings Inc. may be eligible to claim a cash payment from a $14.5 million class action settlement over alleged wage and hour violations.

The hospitals/medical centers included in the Integrated Healthcare class action settlement include:

  • Western Medical Center – Santa Ana (WMC – Santa Ana)
  • Chapman Medical Center (Chapman)
  • Western Medical Center – Anaheim (WMC-Anaheim)
  • Coastal Communities Hospital (Coastal)

The wage and hour settlement resolves two class action lawsuits alleging that Integrated Healthcare Holdings and these four Southern California hospitals violated overtime pay requirements, meal and rest period rules, and other wage and hour laws with respect to employees who worked in 12-hour shift positions and who were paid using the “California Differential” system.

“Defendant’s pay plan essentially created and perpetuated an artificially lower rate of pay for the first eight hours of any workday and then compensated Class Members at an overtime rate based on the artificial lower rate and, if necessary, applied the California Differential to equalize the amount Plaintiffs received,” the consolidated class action lawsuit alleges.

The defendants deny any wrongdoing but have agreed to a class action settlement to resolve the litigation.

Who’s Eligible

Class Members of this class action settlement include all employees who worked in a 12-hour shift position and were eligible to be paid the California Differential at Western Medical Center – Santa Ana (WMC – Santa Ana), Chapman Medical Center (Chapman), Western Medical Center – Anaheim (WMC-Anaheim), or Coastal Communities Hospital (Coastal), at any time between June 5, 2005 and April 4, 2014.

Potential Award

Varies. The amount of money you could receive will be calculated based on the total amount of wages that you earned while working in a 12-hour position subject to the California Differential system during the Class Period, and whether you worked under a Collective Bargaining Agreement.

If less than 100% of Class Members return valid Claim Forms, you may receive more money.

Proof of Purchase

N/A. Claim Forms were mailed to eligible Class Members based on employment records held by the defendant. If you did not receive a Claim Form and believe you are eligible to participate in this class action settlement, contact the Settlement Administrator (details below under the section “Claims Administrator”).
