McCormick & Schmick’s Seafood Restaurants Inc. has agreed to settle a class action lawsuit over claims that it misled consumers about its Kobe beef menu items. If you purchased any menu item advertised to contain Kobe beef at a McCormick & Schmick’s restaurant in California between July 10, 2008 and July 15, 2012, you may be eligible to receive a comp card from the class action settlement.
The McCormick & Schmick’s Kobe Beef settlement will resolve a class action lawsuit (Daniel Flannery, et al. v. McCormick & Schmick’s Seafood Restaurants Inc., et al.) that alleges the restaurant falsely advertised that some of its menu items contained Kobe beef, a specific type of beef that is only available from Japan.
McCormick & Schmick’s has denied all of the allegations in the class action lawsuit, but has agreed to provide comp cards to consumers under a class action settlement that was preliminarily approved on Sept. 20, 2013.
To be eligible for a $15 comp card, Class Members must mail a Claim Form and proof that you purchased a meal in excess of $15 from any California McCormick & Schmick’s restaurant, postmarked no later than Feb. 1, 2014. Class Members who do not provide a qualifying receipt will be entitled to a $10 comp card. Detailed claims filing instructions are provided below.
