Details: The Mattel/Fisher Price Toys Lead Paint class action lawsuit settlement includes toys recalled by Mattel or Fisher Price on 11/21/2006, 8/2/2007, 8/14/2007, 9/4/2007, 10/25/2007 as well as the withdrawal of certain Mattel and Fisher Price products in November and December 2007. The Mattel/Fisher Price lead paint class action lawsuit settlement includes multiple types of claims. Those who returned toys during the Mattel/Fisher Price Lead Paint Toy Recall periods listed above, those who still have those toys in their possession, those who don’t have the toys in their possession because they destroyed or disposed of them because of the recalls but have proof of purchase, those who don’t have proof of purchase but destroyed or disposed of the toys due to the lead paint recall, and those who purchased a recalled toy which Mattel or Fisher Price offer a replacement remedy.

 

A. Those who already returned toys back to Mattel/Fisher Price during the recall periods can (and should) submit a claim as they’re eligible for 50% of the value of the voucher they already received or $10 (whichever is more.)

 

B. Those who still have the Mattel/Fisher Price lead tainted toys in their possession can request return shipping label(s) from the Settlement Administrator by submitting a claim and should receive a check for the value of the returned toys. If your return the toys on your own, and do NOT use a return shipping label provided by the settlement administrator, you will NOT receive a payment to cover the shipping costs. You’ll only receive a payment for the value of the toys returned.

 

C. Those who don’t have the Mattel/Fisher Price lead tainted toys in their possession because they destroyed or discarded them but DO have proof of purchased will be required to submit the proof of purchase and should receive checks or vouchers for the value of the lead tainted toys.

 

D. Those who don’t have the Mattel/Fisher Price Lead Tainted Toys in their possession because they disposed or destroyed them due to the recall AND do not have proof of purchase may claim up to THREE toys by submitting their claim online. Please note, only $10,000,000 is slated for disbursal to this subset of the class. If claims exceed $10,000,000 then each claim will be reduced in size pro-rata (the amount per claimant will be reduced equitably until the $10,000,000 cap is achieved.)

 

E. Those who purchased a Mattel/Fisher Price toy which was included in the lead paint recall but Mattel/Fisher Price offered a replacement are eligible for up to $4 per toy with a limit of three (3) claims per household ($12.)

 

IN ADDITION if you had your child tested for lead poisoning due to the Mattel/Fisher Price toy recall within six (6) weeks of the toy recall and incurred any out of pocket expenses you may submit a claim form for those expenses. Keep in mind that documentation showing the tests were performed and the out of pocket expenses incurred is required.

 

As you can see, documentation is required for all claims EXCEPT for those that fit in the category D. In addition, when you submit a claim you are required to include all or some of the items below:

 

1. Your name and address.

2. Identification of the toy you’re claiming, enough so Mattel can confirm that the toy you’re submitting a claim for was included in one of the lead paint toy recalls.

3. Date of purchased of the toy or the date the toy was received (if it was received as a gift.)

4. Price paid.

5. Name and location of retailer who sold the Mattel or Fisher Price toy.

6. The gender and age of the child who received the toy.

7. The date the toy was discarded or destroyed.

 

It’s extremely important that you fill out your claim form completely for the Mattel Toys Lead Paint Class Action Lawsuit Settlement. If you do not your claim(s) will likely be denied. In addition, your purchase MUST have been made during the purchase period listed on Exhibit A. which is the list of toys included in the Lead Paint Toy Recall. You can find the list  on the Settlement Administrator website or here. Remember, if you list a purchase date of the Mattel or Fisher Price toy outside of the date listed on Exhibit A your claim may be denied.
