Alexia potato class action settlement

If you purchased certain Alexia frozen potato products between December 6, 2007 and July 10, 2013, you can claim up to $35 cash or up to $75 in food product vouchers from the class action lawsuit settlement.

A federal judge preliminarily approved the Alexia class action settlement in July, resolving allegations that Alexia Food Inc. falsely labeled its potato products as “natural” when they contained an artificial chemical called disodium dihydrogen pyrophosphate to prevent discoloration.

Alexia denies any wrongdoing but has agreed to establish a $3.2 million class action lawsuit settlement fund to resolve the litigation. Parent company ConAgra Inc. has also agreed to use citric acid or other naturally-sourced compounds in Alexia potatoes to prevent them from turning brown.

Who’s Eligible

Class Members of the Alexia settlement include anyone who purchased the following Alexia frozen potato products in the United States during the Class Period:

  •     Sauté Reds
  •     Mashed Potatoes Yukon Gold Potatoes & Sea Salt
  •     Mashed Potatoes Red Potatoes with Garlic & Parmesan
  •     Waffle Fries
  •     Harvest Sauté
  •     Italian Sauté
  •     Sauté Sweets
  •     Potato Bites
Potential Award

Up to $35 – $75. Class Members who submit a valid Claim Form by the deadline of November 27, 2013 will be able to choose one of the following class action settlement benefits:

  •     A cash payment of $3.50 for each product purchased (up to 10 products), for a total of $35.
  •     Two $3.75 Alexia product food vouchers for every one Alexia product purchased (up to 10 products), for a total of up to $75.00 in vouchers.
  •     You may also choose a combination of cash and vouchers for up to a total of 10 products purchased. For example, you may file a claim for five cash payments and five voucher awards.

 

A Final Fairness Hearing is scheduled for December 11, 2013. Claims will not be paid unless the settlement is approved and all appeals, if any, are resolved.

It appears that no proof of purchase is required; however, supplying a store receipt will help ensure your claim is accepted.

UPDATE 1: Distribution of settlement awards from the Alexia Potato Products Class Action Settlement will be made mid-June 2014, according to the Settlement Administrator. If you get an award, let us know!

UPDATE 2: Top Class Actions viewers are reporting that settlement checks and coupons were distributed the week of June 16, 2014. Average payouts from the Alexia potato class action settlement are about $16 cash and 20 coupons worth a total of $65 off of future purchases of Alexia potatoes. It’s important to note that awards were reduced pro rata, which means the more valid claims are filed, the less money Class Members receive. Congratulations to everyone who submitted a valid claim and got PAID!

    I haven’t received my coupons yet. I tried calling the number listed but the recording just cuts off. I have my proof that I filed — how to I get ahold of them?

    I received a check for just over $8.00 and 10 coupons for $3.75.

    GOOD LUCK USING the coupons! Tried to use just 4 of them today at Wal Mart. Cashier looked at me like I was a crook and called over her “Supervisor” After they both studied them for a few minutes, they determined that I had copied and printed them from the internet. No, I got them in the mail. They said that since the bar code number was exactly the same on every coupon (which it was) they could only take ONE of them. They made me feel like I was doing something illegal or something. I will not be making 20 separate trips to the store between now and Sept. 12 (the expiration date printed on the coupons) to use them up. Guess I will give some away……one at a time.

      It wan’t a problem using any of the coupons- limit is 4 at same time though. I am in NY.
      And they are dumb- of course the barcodes are the same! Duh! Just like if you had 2 like coupons out of the paper. (And I would have told them that!)
