Korean Air Lines Co., Ltd. and Asiana Airlines Inc. have reached a $65 million class action lawsuit settlement resolving allegations they conspired to fix prices for air passenger travel between the U.S. and the Republic of Korea. If you bought a qualifying ticket between January 1, 2000 and August 1, 2007, you may be entitled to cash and coupons for future air passenger travel as part of the class action settlement.

The Korean Air settlement will resolve a class action lawsuit that claims the alleged conspiracy included meetings, conversations and communications in the U.S. and elsewhere between the two Defendants during which they agreed to establish artificially high prices for air passenger travel.

In cases separate from this class action lawsuit, brought by the United States Department of Justice, the Defendants pled guilty to criminal antitrust violations and agreed to pay a fine. Despite pleading guilty in the DOJ cases, Korean Air Lines and Asiana Airlines deny the allegations raised in the class action lawsuit but have agreed to a settlement to resolve the litigation.

Claim Forms and more information on your rights in the Korean Air Passenger Class Action Settlement can be found at www.KoreanAirPassengerCases.com.

The case is In Re: Korean Air Lines Co., Ltd., Antitrust Litigation, MDL No. 07-01891, U.S. District Court, Central District of California, Western Division.

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.

Who’s Eligible

Class Members of the Korean Air settlement include anyone who purchased at least one ticket for air passenger travel on Asiana Airlines or Korean Air Lines. The purchase must have been:

  • Made in the United States;
  • For a flight originating in the U.S. and ending in Korean or a flight originating in Korea and ending in the U.S.; and
  • Made between January 1, 2000 and August 1, 2007.

Both businesses and individuals may be Class Members.

Potential Award

Class Members that submit a valid Claim Form will receive cash and coupons from the class action settlement, which will be distributed pro rata, based on the total number of qualifying purchases and valid Claim Forms submitted.

My round trip ticket was purchased Nov 1999 but I had to pay a $75.00 penalty Feb 26, 2000, before being allowed to board, for changing the
date. Am I qualified to file a claim?
    Thank you.

Nothing in Colorado. What are the check amounts?

  • steve April 19, 2014

I looked at the site and it doesn’t say checks are out. I hope I’m wrong and everyone gets enough for a trip.

  • Don't listen to the jack April 19, 2014

Checks aren’t out. The guy does this in hopes that we harrass them admin into mailing our checks. Thing is, they are actually monitoring everything he is posting and also everything he apply’s for. There are several people on here that will be in court before long for the crimes they are committing. Enjoy prison!!

    • albert April 24, 2014

What crimes? Putting in 2 claims as opposed to Congress getting paid and not doing anything for 6 years. Or railroad workers in NY going out on disability at a rate of 98%. Cops working 200% their last year and collecting $15000 a month for life. The guy getting 2 checks for a class action what a criminal mastermind. Don’t forget he has to pay for all of the above.

    • CODTY August 2, 2014

HOW IS IT,THAT THE CLAIMS ADMIN. IS ONLY MONITORINGTHIS ONE PERSON? I BELIEVE THE LAYWERS WILL BE IN COURT FOR CRIMINALS CHARGES BEFORE THE CONCUMERS WILL.WHO IS RECIEVING THE MOST MONEY THAT DON’T BELONG TO THEM,WHO IS NOT ABIDING BY THE COURT ORDERS,YOU DO THE MATH

  • Julie April 19, 2014

Funny. I came back to check to see if anyone else had talked to the administrator and I see this. I don’t know why you have me confused with other people since I don’t see any identifying marks in our comments that link us throughout the page. Instead of being a troll, go figure out how you can fulfill your life so that you too can afford the opportunities to travel overseas by way of your employer or your own salary.

  • al April 22, 2014

I just spoke to a representative. They saw my claim in the system, but they said the case is under appeal, so no checks would be sent out until the appeal is solved

  • sharon April 23, 2014

Stop lien ain’t no checks been sent

  • Jessica May 19, 2014

Spoke w Ann from Rust just now, very helpful lady. Several appeals have been filed no checks or vouchers have been released unti all appeals are resolved. Hope this helps those of you waiting with legit claims as myself. Sorry it’s not better news.

  • albert June 25, 2014

Karma, stop cutting and pasting all over the boards. I live in NY. My house taxes are $12000 for an average house. What crimes? Putting in 2 claims as opposed to Congress getting paid and not doing anything for 6 years. Or railroad workers in NY going out on disability at a rate of 98%. These guys are now being convicted and have to pay $25 a month back . They need to live to 390 to pay back their theft. Cops working 200% their last year and collecting $15000 a month for life. The guy getting 2 checks for a class action what a criminal mastermind. Don’t forget he has to pay for all of the above crimes.

  • Patricia August 18, 2014

    Jeremy,
Just because you fly on Korean Air doesn’t mean you have to travel to and from Korea. Korea Air flies to other countries so you don’t know what you’re talking about.

  • BIG JOHN September 9, 2014

UPDATE: The appeals from the Court’s orders granting the judgment of final approval and attorneys’ fees and costs have been resolved. The Claims Administrator is currently performing claim validation and audits on claims that were filed. If anything further is needed from you to validate your claim, you will be contacted. This claim validation and audit process is expected to be completed this year and soon thereafter, eligible class members will be mailed their distribution checks and coupons. The coupons will not be available for use until first quarter of 2015.

That fool kelrok is posting the lie on every claim he can find don’t. believe him.

  • kelrok December 22, 2014

UPDATE: The Claims administrator is currently performing claim validation and audits on claims filed. The validation process is quite extensive and takes time. Once the validation is complete, the eligible class members will be mailed their distribution checks and coupons. We anticipate having further information on the outcome of this process by July, 2015. Thank you for your continued patience. now this is some bull they just keep changing the dates over and over again

  • anna March 20, 2015

are they really allowed to do this? The suit has been settled and at one point I think the judge had said there is no reason to hold up payment. Also, there was no proof needed. Maybe we need to contact the attorneys. Iam sure they have got their settlement, maybe there unaware that checks have not t been sent out as of yet

  • Julia Marie August 26, 2015

This week is officially the end of summer. RUST where are the checks? No nickels and dimes.

  • Julia Marie August 27, 2015

Wow. What a hostile remark? you are probably on crystal meth, not for the HATE SPEECH. By the way September 23rd is the last day of summer. My bad. I should have googled.

  • Mary Jones August 27, 2015

OMG, I agree, such hostility, she probably never traveled internationally, probably some HOOD RAT watching Jerry Springer glued to day time tv and this website all day long..

    Yet no money honey damn

  • Henry September 1, 2015

    What date is late summer?

  • jennifer September 2, 2015

what a freaking scam. it amazes me how government and big business can manipulate the system and get away with it. funny they are not held to same standards as us little folk. this settlement has been dragged out for months and we have been lied to repeatedly about when we would receive our vouchers/refunds. I think they were hoping we would all forget and their corrupt lawyers could just pocket it all. I am so disgusted with this company and with Rust. goes to show how little we all mean to corporations that can continually scam us and get away with it. what a joke.

  • Boones farm September 7, 2015

Jan 2016 checks will come out

  • amy September 8, 2015

What state you live in and how much were the coupons?

  • Shelby white September 10, 2015

What the hell fall starts what September 23rd Korean posted on there website checks be mailed late summer. I know there not allowed to lie. Any new information or I’m start writing letters we’ve had enough of this everyone needs to move on.

  • Shelby white September 10, 2015

I just left a message with The Federal Trade Commissioner. I suggest yall do the same this is ridiculous.

  • Kathleen September 10, 2015

Are their any updates on the settlement? Are they really going to start sending out coupons and payments by the end of the summer?

  • Marcy September 11, 2015

This is for the Korean Airlines Anti-Trust Lawsuit….I got this from the BBB today written by RUST>>>>
\09/08/2015 : Rust Consulting is in receipt of complaint #…, which relates to In re Korean Air Lines Co., Ltd. Antitrust Litigation, No. CV 07-05107, MDL No. 1891 (C.D. Cal.). Rust is engaged as the Settlement Administrator in this matter with the objective of carrying out the terms of the settlement from a neutral, administrative perspective. Rust is not a party to the settlement and does not have the authority to act outside of its terms.\
Rust has completed processing of all claims in the settlement. Distribution, however, is on hold pending submission of the plan of allocation to the court, and the court’s approval of the plan. In addition, the parties to the settlement are actively working to set up a redemption process, including a brokerage site which will allow class members to sell a portion or all of their coupon/voucher in exchange for money.
Updates will be posted to the settlement website, https://koreanairpassengercases.com/, as they become available. Rust acknowledges that the process has been quite extensive and thanks class members for their continued patience.

  • Kathleen September 13, 2015

UPDATE: KOREAN AIRLINES UPDATE THIS INFORMATION ON SEPTEMBER 11, 2015. This is an update on the distribution to claimants of the settlement fund and the coupons. The allocation to claimants is based, pro rata, on qualifying purchases of travel during the class period. Each approved claimant will receive a pro rata distribution of the cash settlement fund, along with a proportional share of coupons from Asiana and from Korean Air. The coupons will be distributed in the form of electronic codes. It has taken longer than anticipated to establish and build the electronic connections between the coupon database and the airlines’ systems. We are also building a separate website to facilitate the transfer and exchange of the coupons. We are nearing the end of the process and we appreciate your patience while the process is completed.

If you have an update to your information, such as a change of address, please email it to info@KoreanAirPassengerCases.com.

  • Sharon September 14, 2015

    They lien

  • Sharon September 14, 2015

    Where is the money

  • Shelby white September 15, 2015

The checks are $134 per trip and $20 coupon who builds a dumb website to cash a $20 coupon. You know what the hell I paid to go on korean airlines, lets start another class im not putting up with this bullshit now they gone try pay in December who the fuck does that, federal trade commissioner already contacted rust there needs to be an investigation. I read that the GCG adminstrator out of Washington state the employees stole a lot of the money out of that Burger King case, this sounds like the samething. Start writing letters and documenting everything

    • Max September 16, 2015

      How do you know this?

  • Mary Jones September 16, 2015

Wow, that is my response. After a couple years waiting, all the checks are going to be is for 134.00 per trip knowing that international travel is in the thousands of dollars and a $20 coupon. If that is true, what a major rip off. Rust is not a ethical 3rd party or escrow entity.

    • Sky September 18, 2015

$134 per trip. Thats not bad. I had 12 trips.

      • sara September 18, 2015

READING FROM THE UDATE,EVERYONE WITH A APPROVED CLAIM WILL BE PAID PRO RATA,MEANING EVERYONE WILL RECVD THE SAME AMOUNT.HOPE THIS COMMENT HELP,GOOD LUCK EVERYONE THAT HAS FILED.

        • Max September 23, 2015

I thought pro rata meant prorated, meaning everyone gets the same amount per trip. So a person would get a different amount compared to someone that claimed 1 trip vs. 12 trips.

          • sara September 23, 2015

YES, THAT IS WHAT PRORATED MEAN.YOU KNOW THEY ARE GOING TO FIND AWAY TO CHEAT US OUT OF OUR MONEY

  • cuttie sugby September 16, 2015

cuttie sugby so what did they say ?did you talk to someone?

  • Shelby white September 17, 2015

Call Rebeccavwt Rust she’ll tell you how much your check gone be and coupons. Get your tissue ready. (612)359.2907 and you wont get it till December or January

    • sally September 17, 2015

Shelby, did she tell you how much payments are going to be?i call the number you posted, and recvd very little info from her

  • cuttie sugby September 17, 2015

did anyone find out how much checks will be. and when will they be mailed

  • dennis cejka September 20, 2015

By the time we get paid it wont be worth a heck. The longer they work on the case the more cash they get to keep. They get rich we all go poor!! Sad they keep pushing it back so much. Starting to think it will never pay and even if it does it wont be worth a heck anyways by the time the lawyers eat it up. Does not seem fair overall. Just my thoughts on it.

  • Mary Jones September 21, 2015

Your thoughts are accurate. The lawyers and the 3rd party escrow/clearing houses are the ones getting paid. If they knew they had to make special databases, Why wait to the last minute? They had 2 years to complete this class action. Its a scam for the lawyers and Rust to keep all the money and probably send 65.00 dollars and a 20.00 coupon to the rest of us.

  • Mr. b September 27, 2015

Any update’s on when check’s will be mailed

  • Mr. b October 14, 2015

  • Mr. b October 17, 2015

How does Sharon know that check’s will be mailed on 10/19/2015

  • Dee October 18, 2015

Checks were mailed Friday. Message is posted on here under News. Here is the last part of the message I copied……….. The airline price-fixing class action lawsuit claims that the terms of the settlement was mailed to more than 160,000 Class Members and there wasn’t a single objection.

    • UAGS October 18, 2015

I believe that was for a different case (Cargo).

    • Ton October 18, 2015

Sorry Dee, but that is the freight class action you read about, not this case. Both involve Korean airlines. Sorry

    • Paul October 18, 2015

The Korean Airline Passenger case had 70,000 claims and many were thrown, mainly from Korean nationals or individuals who applied from Korea, making the pool much smaller. One website had the checks at $500 each, but since the pool is smaller it should be around $725 each. The website hasn’t been updated since 9/11 which means they aren’t mailing anything out and have no plans to do so in the next month.

      • Paul October 18, 2015

I also called the lawyers in San Francisco and apparently, they are bewildered why it is taking so long and have no information other than it was settled more than 2 years ago. Since it went to the administrator it is now out of their hands.

    • carla October 22, 2015

dee, what article did you read that new from, showing where checks had been mailed from koreanair settlement?please respond back

  • Mr. b October 18, 2015

This does not sound like it is the Korean Air passenger lawsuit I think that this is a different lawsuit and no where did it say that check’s were mailed it said notice’s wrong lawsuit.

  • ghost October 31, 2015

You guys may want to look at this page very intreasting https://koreanairpassengercases.com/english/mainpage/FrequentlyAskedQuestions.aspx.

    • Paul November 1, 2015

your point…. nothing new there. There is no law dictating how long the process takes, the fees involved and any disclosure of such. Point is they can take as long as they want, not disclose how much they were paid and how they came to the final numbers. Its been two months since an update. It normally takes 2-3 weeks to do what they claim to be doing. Also, most administrators, as soon as you fill the paperwork out, due the due diligence and apparently they didn’t and change the way the payout was as they went a long. I’m tired of this… very tired and sick too btw.

  • Mr. b November 2, 2015

What is really going on with the disbursement of these check’s does anyone have any idea’s I think maybe they paid off another lawsuit with the Korean airline’s fund’s and their waiting for another lawsuit to come in so they pay us what do you all think.

  • burt t jackson November 10, 2015

Looks like we may see checks early next year at soonest

  • John November 13, 2015

This has been going on since 2013. We all know Rust Consulting is corrupt.

    Don’t be expecting anything.

  • Paul November 25, 2015

Dont expect anything to be done until at least March of next year from what this is saying. On November 23, 2015, the business provided the following information:
Rust Consulting is in receipt of complaint #57318194, which relates to In re Korean Air Lines Co., Ltd. Antitrust Litigation, No. CV 07-05107, MDL No. 1891 (C.D. Cal.). Rust is engaged as the Settlement Administrator in this matter with the objective of carrying out the terms of the settlement from a neutral, administrative perspective. Rust is not a party to the settlement and does not have the authority to act outside of its terms.

Distribution is on hold as the parties to the settlement work through the logistics of the redemption process, including the brokerage site which will allow class members to sell a portion or all of their coupons/vouchers in exchange for money. Once the plan of allocation has been finalized, it must be submitted to the court for approval. Rust cannot provide class members’ individual payment amount details until the court has granted final approval of the plan of allocation because the amounts are subject to change up until that time.

Any updates Rust receives from the parties regarding the status of the settlement and timeline for distribution will be posted to the settlement website, https://koreanairpassengercases.com/.

    what happened w/the settlement?

  • Nick01 December 29, 2015

The amount of the cash refunds and bonus coupons are not known SINCE RUST is stilling developing a database to interact with Korean Airs data bases and creating another set of databases for the claimants to trade/sell their bonus coupons to others. RUST is using up as much of the money as they can for themselves, only after everything is completed and paid for, then they will calculate the cash awards and bonus coupon amounts. FIRST, the lawyers took their share, now RUST is eating up as much as they can. This process is no surprise to RUST since they make a significant part of their business doing this work for numerous class action suits. RUST knows what they are doing, they are trying to use up as much of our money as they can for their own business. LAWYERS first, RUST second, we last. We got srew*d by Korean Air, then LAWYERS and now RUST. Triple play. Nick01

    • sara December 29, 2015

this is sad the way we are being treated with this settlement.

  • Sue December 30, 2015

This is the situation: There was a final settlement in 2013, and money for refunds and coupons determined.

Then the LAWYERS in the class action suit got their cut. Next there was to be a verification and

distribution made to claimants. RUST Consulting was given that job. RUST consulting first verified

the claimants’ applications. Next, RUST Consulting decided to build a data base to interact with

Korean Air’s data base. (This likely was not necessary). Next RUST Consulting decided to build a

data base to permit claimants to sell their coupons to others. (This likely was not necessary).

So, why is RUST Consulting doing all of this extra work?? They are doing it to eat up the claimants

cash awards. Rust Consulting is a company that makes a significant part of its revenue in Class Action Suits. Thus the claimants refunds cannot be distributed because the amount of cash refund is unknown until

RUST Consulting completes all their extra work and gets paid from our cash awards. First of all Korean Air got us, next the LAWYERS got us, and now RUST Consulting is getting us. They are all eating up our cash refunds and the amount of the bonus coupons. Feels really good, doesn’t it?

    UPDATED: January 13, 2016

Settlement Class Counsel filed a motion for distribution of the settlement funds (both cash and coupon) before Judge Otero, the judge overseeing the case. A hearing has been scheduled for February 8, 2016, and it is expected that the Judge will issue an order shortly thereafter. Once the order is issued, Rust, the claims administrator, can begin distributing the settlement funds and the coupons codes to claimants.

We are nearing the end of the process and we appreciate your patience while the process is completed.

    • BRENDA B. January 13, 2016

We’re is the court house some of us need to attend tell judge, all the lies Rust told us we get paid late summer 2015 then a phonetic data base invention now our attorneys had to take Rust to court on Feb 8th to tell Judge what Rust has been doing to us. You know the GCG settlement administrations out of Washington state stole a of people’s money on the Burger King class action, are these companies that desperate.

    • lc February 3, 2016

this is so sad,Rust will eventually get whats coming to him,you reap what you sow, they are not answering any phone calls now.they are drained from lying.

  • Paul February 5, 2016

I looked at the docket for Monday and it is not listed. I am calling tomorrow to find out what the deal is also I have sent an e mail out to the clerk to find out why. Its the USDC CAC (US District Court Central District of California). Judge S. James Otero.

  • Karla February 5, 2016

I am from Louisiana, and I haven’t heard much about the settlement. What is going on? They keep taking a long time. I am planning a trip to Asia. I hope all this time, I have wait for is worth it and that they stop lying about the settlement.. What is really going on ???? I need to know now we can’t even talk to a live person everything is just the automatic message!

  • Paul February 5, 2016

I received an e mail from the court of clerks. The judge granted the motion early so the hearing was cancelled. Lets see how fast the website is updated and hopefully within 90 days everything will be settled. Good luck everyone.

  • Paul February 7, 2016

Just read the court documents $38 million to the respondents this means around $540 per claim. (70,000 claims were made) This exclusive of the amount that were denied and from Korea that were denied. $371 for each coupon. This is an estimate though….It was signed off on the 3rd of February and ordered Rust to make immediate payment. The judge signed off on it the same day. One major hold up was a travel agent claiming that they deserved to be in the class action settlement due to purchasing tickets for its clients. They appealed the motion several times, including this one, to be included, but the judge ruled they only purchased tickets for clients and all their claims were denied. The final numbers are dependent on the amount of claims denied to this one agency and if the 70,000 claims were each ticket per person or person (which may have more than one claim I have 92). Hopefully it will all settled in the next 90 days or so.

  • alice February 8, 2016

Has anyone called rust yet to determine the value of their claim, and when they intend to send them out?

  • mike February 10, 2016

checks go out next week. $540 for each ticket claimes and than the vouchers for $371.

    • ton February 11, 2016

Mike where did you hear or get this good news? thanks

  • Top Class Actions February 10, 2016

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.

    • david thames February 10, 2016
