Audi CVT class action lawsuit settlement

Details on how to file a claim for the Audi CVT class action settlement that was preliminarily approved in March have arrived. If you purchased or leased a 2002-2006 model year Audi A4 or A6 vehicle equipped with a factory-installed CVT transmission, you may be eligible to claim a cash award from the class action lawsuit settlement.

The Audi CVT settlement will resolve a 2011 class action lawsuit (Sadowska v. Volkswagen Group of America) that alleges Audi knowingly sold these vehicles with defective transmissions and failed to honor warranty repairs on them.

Audi denies the allegations but has agreed to reimburse consumers for certain repairs and costs incurred from the allegedly defective CVT transmissions as part of a class action lawsuit settlement to resolve the litigation.

Class Members of the Audi CVT settlement include all U.S. purchasers and/or lessees of any 2002, 2003, 2004, 2005 and 2006 model year Audi A4 and Audi A6 vehicle originally equipped with a factory-installed CVT Transmission, imported and distributed by Volkswagen Group of America Inc. for sale or lease in the United States of America.

As a Class Member, you’re entitled to one of the following benefits if the class action lawsuit settlement is granted final approval at the September 23, 2013, Final Fairness Hearing:

(1) Cash Reimbursement: To the extent not previously reimbursed, a cash reimbursement will be available for the cost of a previously paid for repair or replacement of a qualifying CVT transmission part(s) which occurred within the earlier of 10 years or 100,000 miles from the date of the first original purchase or lease of the vehicle, whichever occurred first, and prior to June 19, 2013.

To receive a cash reimbursement, you must mail a Claim Form and required proof postmarked no later than November 18, 2013.

(2) Warranty Extension: Audi’s New Vehicle Limited Warranty will be extended to cover repair or replacement, by an authorized Audi dealer, of a qualifying CVT transmission part(s) during a period of 10 years or 100,000 miles from the date of the first original purchase or lease of the Settlement Class Vehicle, whichever occurs first.

(3) Documented “Trade-In Reimbursement Costs”: If you submit documented proof that prior to June 19, 2013 and within the above-referenced 10 year or 100,000 mile (whichever occurred first) period, you sold or traded-in a Settlement Class Vehicle because it had a malfunctioning CVT transmission, you can receive the difference between the amount of money you received from the trade-in and the “trade-in value” of the vehicle.

Further details on these settlement benefits, as well as a Claim Form, can be found at www.CVTSettlement.com.

I bought a used 2003 Audi A6 that I had less than 6 months with a transmission issue. I had no choice but to voluntarily send it back to the used car lot that I got it from because I couldn’t afford to fix the transmission. The dealership (during the very beginning of the first start of covid mind you) came and got it, sold it at auction “as is” for 300.00 because they already know it wasn’t worth a crap! Now the dealership is suing me for returning it for more than the original amount I signed for! I obviously had no money if I went to a “buy here pay here”, all my payments were on time and up to date when I returned it, so it’s not like I wasn’t trying to pay for it. I only had a certain amount to put down and with it being such a later model and that’s the only car on the lot my down payment would cover, I had no choice. I figured since the car only had one owner prior to me and it was only 100k miles that it would be safe. I had no idea it would, less than 6 months take a crap on me and I had to get a car in a hurry because the car I had for 10 years had finally quit on me (350k miles later). The terrible part is that there’s no laws for the consumer here in the state of TN for these buy here pay here ppl to rip off those who are already down on luck, money and no other options. I bought the car in 2020, I have to start another car payment when I had no car and had to send that one back. I had no clue of the class action deal with these transmissions and when I bought the car it was too late anyways. What can I do to keep from paying for this car still that I shouldn’t have to pay for? I have no rights, no money, I’m a single mother of 2 and I work over 40 hrs a week and my childrens dad won’t pay his child support (that’s a whole other story). I missed my payment 1 time and they levied every penny in my bank account (which was my rent money) and left my high and dry. I absolutely can’t afford to pay for this car anymore and to be honest, that car lot already knew there was a problem with the tranny. Do I have any rights? How do I fight this? Any advise anyone could give me would be awesome!!

  2. Melinda Atkins says:

Purchased a used Audi 2006 A4 75000 miles had it 4 months and the transmission is gone. Audi dealer’s will not even work on their own car’s older than 10 year’s old.

  3. Mary says:

Unfortunately, I just bought a used 2003 Audi A4 3.0 with a cut transmission for a second vehicle. Looked great, no warning lights, only 84000 miles. Not even a week later the engine light came on and am having to take it to the shop. Too bad you really have too look for these specific problems. I looked up the ratings for the car and noticed good reviews. I usually lease and this was my first used car. I guess you live and learn. I am still waiting from the mechanic to get a diagnosis. To bad the 10 years is up!!’

  4. GiriA says:

I have 2004 Audi A4 Cabriolet 3.0L and replaced the Transmission Control in 2011 and paid the dealership around $2, 500; and came to know recently that I can claim for a reimbursement and I have submitted the receipt from the dealer along with all other supporting documents to the mentioned address (CVT Claims Administrator, P.O. Box 2987, Faribault, MN 55021-2987), but the mail came back to me.
I tried to call the 800 number as well but it says not in service, can anyone guide me how to claim this?

  5. Roy Rampersad says:

Is this claim available for owners residing in other countries

  7. Alexis says:

Can someone notify attorney Robert Starr or Federal Judge A. Howard Matz who handled this class act lawsuit. CVT Claims administrator continuously to decline their responsibilities, duties and orders to reimburse the victims in this case like myself by asking for documents and said they would not pay me for irrelevant reasons. Not only did I spent thousands of dollars in repairs, but had to traded in for pennies to the dollars (cost) due to this transmission malfunction. I have not received any money for the documented transmission repairs or trade-in reimbursement cost. Anyone’s assistance will be appreciated. Thank you!

  8. Yazmin Santana says:

I bought a 2005 audi with 85000 miles in May 2013. I been having problems with it since then. I took it to my local Foriegn car mechanic. He notify me about this lawsuit. What can I do since my car has this problem? My car has 9200 miles now.
