Details: The Steve Madden text settlement will resolve a class action lawsuit, titled Ellison v. Steven Madden, Ltd., that alleges the company sent unsolicited text messages to consumers advertising Steve Madden’s fashion products and promotional events. According to the class action lawsuit, these text ads violated the Telephone Consumer Protection Act because consumers did not consent to receive them.
Steven Madden denies any wrongdoing but has agreed to a $10 million class action lawsuit settlement to resolve the litigation.
Class Members of the Steve Madden text class action settlement include all U.S. persons who, from July 2010 until September 25, 2012, received a text message promoting Steve Madden products and/or events from the “short codes” 91919 or 623336.

In addition to promising not to send future unauthorized text messages, the Steven Madden text settlement will allow Class Members to the opportunity to remove their cell phone number from any list or database of cell phone numbers to which text messages could be sent promoting Steve Madden products or events.
Class Members can also receive up to $150 if they submit a valid Claim Form by June 11, 2013. Settlement checks will be mailed within 60-90 days after the Settlement has been finally approved and/or after any appeals have been resolved.
A Final Fairness Hearing is scheduled for April 29, 2013.

checks were mailed aug 16 ,the lady said if you didnt get one you won’t get one ,talked to her today 11/14/2013
Steve Madden company sends a list of phone numbers where text messages were send. Settlement administrator will look for your reported phone number and if its a match you get the check. Thats how the system works I do not believe anyone was targeted here on this claim.. Over 5000 claims did not match phone number on their database that text messages were send.
Spoke to someone at settlement admin 888 643-2166 at 11:21am today and was told that checks were in fact mailed on August 16th, I was determined to be ineligible (they did not say how that determination was made) nor do they intend to send any letters. If you have not received a check yet, then you will not be getting one. All determinations are final and cannot be appealed.

Why didn’t TCP let us know checks were mailed? I receive multi text and did not get a check. Yes was told checks mailed Aug 16, 2013. TCP please verify.
