Buffalo Bills class action settlement

Buffalo Bills Inc. has agreed to settle a class action lawsuit alleging it sent unwanted text messages to some recipients. If you received informational text messages from the Buffalo Bills as a subscriber to the Buffalo Bills text alert service between Sept. 12, 2008 and Jan. 15, 2014, you could be eligible for benefits from the class action settlement.

The Buffalo Bills text spam class action lawsuit alleges the Buffalo Bills sent unwanted text messages in violation of the Telephone Consumer Protection Act (TCPA). Plaintiff Jerry Wojcik alleged he signed up for an alert service that would deliver team news, promotions and updates. According to the TCPA class action lawsuit, the messages would be limited to five per week, for a period of 12 months. Wojcik alleges he received more than the weekly maximum of five text messages in a week.

The Buffalo Bills have denied all wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense, inconvenience and inherent risk of litigation.

Who’s Eligible

Class Members of the Buffalo Bills class action settlement include anyone in the United States who, between Sept. 12, 2008 and Jan. 15, 2014, subscribed to the Buffalo Bills text service by texting the word “BILLS” to the SMS short code 64621 in order to receive SMS text message alerts, and received more than five text messages from the Buffalo Bills within a week.

Potential Award

BBI Debit Card worth between $57.50 and $75.

Eligible Class Members will receive a BBI debit card which is redeemable up to its face value for merchandise purchases online at www.shopthebills.com or in person at the official Buffalo Bills team store located on the grounds of Ralph Wilson Stadium in Orchard Park, N.Y.

  • Class Members who received more than five text messages in at least one but no more than 14 weeks while subscribed to the text alert service will be eligible to receive a BBI debit card worth $57.50.
  • Class Members who received more than five text messages in at least 16 but not more than 33 weeks while subscribed to the text alert service will be eligible to receive a BBI debit card worth $65.
  • Class Members who received more than five text messages in 34 or more weeks while subscribed to the text alert service will be eligible to receive a BBI debit card worth $75.

Under the terms of the TCPA class action settlement, Class Members are entitled to receive a maximum of one BBI debit card.

Proof of Purchase

Class Members must provide the cell phone number that received the text alerts from Buffalo Bills Inc. The cell phone number will be checked against a list of numbers that signed up for the text alert service.
