Kobe beef class action settlement

Innovative Dining Group LLC has agreed to settle a class action lawsuit alleging it falsely represented food items at some of its California restaurant locations as containing Kobe beef. If you purchased and/or consumed a food item represented as containing Kobe beef from any California restaurant owned and operated by Innovative Dining Group between Oct. 3, 2008 and May 30, 2014, you could be eligible for benefits from the class action settlement.

According to the class action lawsuit, the term Kobe beef implies that the beef comes from the Wagyu bloodline of cattle, which are raised in the Kobe region of Japan. The plaintiffs allege that Innovative Dining Group’s restaurants advertised some of its menu items as containing Kobe beef even though the U.S. Department of Agriculture banned beef imports from Japan from May 2010 to August 2012.

Innovative Dining Group denies the allegations in the class action lawsuit and maintains that it has truthfully represented their food products. However, Innovative Dining Group agreed to settle the Kobe beef class action lawsuit to avoid the burden, expense and risk of continuing litigation.

Who’s Eligible

Class Members of the Kobe beef class action settlement include “All persons who were exposed to online and/or in-store menus and who purchased and/or consumed a food item represented as containing ‘Kobe’ beef” from any restaurant located in California that is owned, managed and/or operated by Innovative Dining Group between Oct. 3, 2008 and May 30, 2014.

The participating restaurants include:

  • Boa Steakhouse – Santa Monica
  • Boa Steakhouse – Sunset
  • Delphine restaurant
  • Katana restaurant
  • Sushi Roku – Hollywood
  • Sushi Roku – Pasadena
  • Sushi Roku – Santa Monica
Potential Award

Class Members who submit a valid Claim Form will be eligible to receive a gift certificate to the participating restaurants. Class Members who submit proof that they purchased a meal in excess of $15 from one of the participating restaurants will be issued a $20 gift certificate, while Class Members without proof will be issued a $10 gift certificate.

Proof of Purchase

None required. However, Class Members who submit proof that they purchased a meal in excess of $15 from one of the participating restaurants will be entitled to greater benefits from the Kobe beef class action settlement.
