A settlement has been reached in a class action lawsuit against the Law Firm of Phelan Hallinan & Schmieg LLP to resolve claims that the company violated the Fair Debt Collection Practices Act (FDCPA).

The pending class action lawsuit alleged that Phelan Hallinan & Schmieg LLP attempted to collect overdue debts related to real estate mortgage loans and in a mortgage validation letter sent by the company, the letters allegedly included statements that were in violation of the FDCPA. The lawsuit seeks damages to recover alleged FDCPA violations as well as attorney fees and costs.

The current settlement was a result of negotiation by both sides and was not ad admission of wrongdoing by the Defendants Phelan Hallinan & Schmieg LLP.  The FDCPA class action settlement was reached to avoid further cost and risk of the case going to trial.

The settlement Class is expected to include approximately 18,300 members and the settlement total is $500,000.

Who’s Eligible

The settlement Class consists of any Pennsylvania consumers including “any natural person obligated or allegedly obligated to pay any debt who was mailed a Validation Letter from Phelan Hallinan & Schmieg, LLP dated between October 23, 2009 and October 22, 2010, inclusive, and which related to a mortgage secured by real property in Pennsylvania for personal, family, or household use. Excluded from the Class are Defendants, any parent, subsidiary, or affiliate of Defendants, and all governmental entities.”

Those who wish to exclude themselves from the settlement or object to the settlement must do so by Feb. 22, 2016.

Potential Award

Up to $1,000.

Based on the total number of valid claims received after the filing deadline, the funds will be distributed on a pro rata basis and will be divided equally among claimants. The estimate for payment is estimated to fall between $27 and $1,000 per claimant.
