East Bay Motorsports has agreed pay nearly $1 million to settle a class action lawsuit alleging it engaged in unfair and deceptive business practices in connection with the sale and financing of motorcycles through branded credit cards.
The plaintiff contents that East Bay Motorsports sold motorsports pursuant to credit card transactions without making all of the disclosures required under California’s Rees-Levering Automobile Sales Finance Act, a law that governs the sale of motor vehicles under conditional sales contracts.
Specifically, the plaintiff alleges East Bay Motorsports failed to provide motorcycle buyers with all documents and financial disclosures required under California law for the sale of motor vehicles under conditional sales contracts, and that the company made false and deceptive representations concerning interest rates and payment terms to buyers who purchased motorcycles using credit card financing.
East Bay Motorsports denies the allegations and contends that it made all necessary disclosures. However, the company has agreed to settle the class action lawsuit to avoid the expense and uncertainty of trial.
If you wish to opt out of or object to the East Bay Motorsports class action settlement, you must do so no later than Jan. 14, 2016.
Who’s Eligible
Class Members include all California consumers who purchased motor vehicles from East Bay Motorsports, financed in whole or in part through open end credit card accounts arranged by East Bay Motorsports at any time between June 10, 2007 and April 11, 2014.
Potential Award
Varies. The amount each claimant will receive from the class action settlement depends on the amount of money they financed to purchase a motor vehicle from East Bay Motorsports using open-ended credit card financing arranged by East Bay Motorsports.
