Details: A California Superior Court has preliminarily approved a class action lawsuit settlement with OSI Restaurant Partners, owners of Fleming’s Prime Steakhouse & Wine Bars. If you dined at a California Fleming’s restaurant between June 2010 and February 2011 and paid your bill with a personal credit card, you may be entitled to receive a $50 voucher from the class action settlement.
The Fleming’s settlement will resolve a class action lawsuit, entitled Allred v. OSI Restaurant Partners, LLC, that alleges Fleming’s Prime Steakhouse & Wine Bar used a credit card form in its California restaurants and bar areas that contained a preprinted space specifically designated for filling in the telephone number of its credit card customers in violation of California law.
OSI denies the allegations, but has agreed to a class action lawsuit settlement to avoid ongoing litigation.
Class Members of the Fleming’s Steakhouse settlement include any Fleming’s customers who, between June 7, 2010 and February 23, 2011, dined at a Fleming’s restaurant (including the bar area) in California and paid their bill with a personal credit card. Class Members who submit a valid claim form by the deadline of October 2, 2012 can receive a Fleming’s voucher worth $50.
A Fairness Hearing is scheduled for October 26, 2012. Settlement vouchers will be mailed within 20 days after Final Judicial Approval.
