A settlement has been reached in a class action lawsuit alleging Il Fornaio (America) Corporation violated California law and federal law by failing to provide required breaks and failing to pay all wages owed to its employees.
If you were employed as a non-exempt employee at any of Il Fornaio’s California restaurants at any time between Feb. 1, 2007 and Aug. 24, 2015, you may be eligible for a cash payment from the class action settlement.
Plaintiff Wendy Williams filed an amended wage and hour class action lawsuit against Il Fornaio on April 14, 2014. She alleges Il Fornaio failed to provide its employees with rest and meal periods, failed to timely pay wages, failed to provide accurate wage statements, failed to pay all wages owed (including overtime pay, and unlawfully deducted certain wages.
Il Fornaio denies the allegations and maintains that it did not violate wage and hour laws. However, the restaurant company has agreed to pay a minimum of $1.5 million to settle the class action lawsuit and avoid the risk and expense of trial. There are approximately 5,700 Class Members who may be eligible for payment from the Il Fornaio wage and hour settlement.
Who’s Eligible
Class Members of the Il Fornaio wage and hour settlement include: “Any and all persons employed by Il Fornaio as non-exempt restaurant employees, however titled, at any of Il Fornaio’s California restaurants at any time from February 1, 2007, through August 24, 2015, excluding those persons who have previously entered into a settlement with, and previously released, Il Fornaio with regard to any of the settled claims.”
