Details: Boiron, Inc. has reached a class action lawsuit settlement that will provide up to $5 million in refunds to consumers who purchased any of 23 different Boiron homeopathic products, including Oscillo, Arnicare, Chestal and Coldcalm, as well as all other generic and other-branded homeopathic products manufactured by Boiron. Class Members who file valid claims are eligible to receive up to $100 from the class action settlement. The Boiron settlement will resolve a class action lawsuit, entitled Galluci v. Boiron, Inc., that alleges Boiron made false claims about the effectiveness of its homeopathic products’ treatment of ailments such as the flu, arthritis, sore joints, joint pain, aches, fever, coughs, insomnia or sleeplessness. Plaintiffs in the class action lawsuit alleged the active ingredients in Boiron’s products are so diluted that they are “effectively non-existent,” making them little more than sugar pills. Boiron denies any wrongdoing, but has agreed to create a $5 million class action lawsuit settlement fund to pay out Class Members to resolve the litigation. Class Members of the Boiron homeopathic product class action settlement include all persons who purchased one of the following Boiron products after January 1, 2000. You are not a Class Member if you were a California resident whose only purchase of a Boiron product was of Children’s Coldcalm in California after August 31, 2006.

Products covered by the Boiron class action lawsuit settlement are: Acidil, Arnicare, Avenoc, Calendula, Camilia, Chestal, Chestal Children’s, Cocyntal, Coldcalm, Coldcalm Children’s* *Excluding sales to California residents who purchased Children’s Coldcalm in the State of California after August 31, 2006. Cyclease, Gasalia, Optique, Oscillococcinum, Oscillococcinum Children’s, Quietude, Roxalia, Sabadil, Sabadil Children’s, Sedalia, Sinusalia, Sportenine, Yeastaway

All other generic and other-branded homeopathic products manufactured by Boiron and sold in the United States, including any variations, formats, dosages, dilution or packages. As part of the class action lawsuit settlement agreement, Boiron has agreed to make certain changes to the way it advertises its homeopathic products, as well as provide refunds to customers.

Claims Submitted with Proof of Purchase: If you can provide Proof of Purchase from any retailer in the United States (e.g., receipt or packaging), you are entitled to a refund of the amount shown on the receipt or the suggested retail price of the product as determined by information on the packaging, such as bar or SKU code, subject to a cap of $100 per household.

Claims Submitted without Proof of Purchase: If you are unable to provide Proof of Purchase but affirm under penalty of perjury that you purchased a product during the Class Period, you may submit a claim for $10 per product, with a cap of $50 per household. To receive any money from the Boiron class action settlement, you must submit a claim form and any supporting documents postmarked by the Claim Filing Deadline, which will be 45 days after the date the Court enters the final judgment.  A Fairness Hearing is set for August 13, 2012, which means the Claims Filing Deadline could be as early as September 27, 2012.

UPDATE 2: Payments from the Boiron class action settlement were finally mailed in late September/early October 2015. Congrats to everyone who submitted a valid claim and got paid!
