Details: The Skechers settlement will resolve a class action lawsuit, entitled Grabowski v. Skechers U.S.A., Inc., that alleges Skechers violated state laws and consumer protection statutes by misrepresenting the benefits of wearing Skechers toning shoes, and that the shoes did not provide the benefits claimed.

Skechers denies any wrongdoing, but has agreed to establish a $40 million class action lawsuit settlement fund to resolve the litigation.

As part of the Skechers toning shoe class action settlement, Skechers is barred from making claims about strengthening, weight loss, and other health and fitness-related claims for its toning shoes unless they are true and backed by scientific evidence. The Skechers class action settlement also bars the company from misrepresenting any tests, studies or research results regarding toning shoes.

Skechers has also agreed to provide refunds to consumers who bought the following Eligible Shoes as new since August 1, 2008:

Skechers Shape-ups rocker bottom shoes
Skechers Resistance Runner rocker bottom shoes
Skechers Shape-ups Toners/Trainers
Skechers Tone-ups with podded outsoles
Skechers Tone-ups non-podded sandals
Skechers boots
Skechers clogs
Skechers trainers (Tone-ups, non-podded sole)

The total refund you can receive from the Skechers shape-ups class action lawsuit settlement will depend on how many Eligible Shoes you purchased since August 1, 2008, as well as the total number of valid claim forms submitted by other Class Members. However, it’s estimated that Class Members will receive between:

$40 – $80 for Shape-ups;
$27 – $50 for podded sole shoes;
$20 – $40 for Tone-ups (non-podded sole); and
$42 – $80 for Resistance Runners

    I remember running out paying right at $100 for the shape ups thinking how awesome they would be to workout in. I still have those same shoes I bought several years ago…why? because not only could I not walk right in them without almost falling but they did not do what was claimed I was very disappointed. So, I faithfully gave Sketchers another chance with the tone ups and same thing just not as bulky of a shoe. Those shoes are dangerous literally. I fell a few times in my shape ups and one time my foot bent sideways causing slight sprain . I was so hopeful in these shoes but to pay that much I should have listened to my step mom and bought the less expensive ones at that time and I would not have felt duped.

    I bought 2 pairs of Shape-Ups, 1 for myself and 1 for my daughter. Thankfully, my daughter didn’t wear them much, just made her too tall. hahaha!! Unfortunately, though, I wore them all the time. Well, that’s something I seriously regret now. After many months of wearing the Shape-Ups, my right ankle and foot (fascia) started killing me. Went to see a foot and ankle surgeon who immediately asked me about the shoes. He said that he had been hearing a lot of complaints about people’s ankles who were wearing the Shape-Ups. For me, the damage had been done. I had to have surgery for the torsal tunnel syndrome that the shoes had caused because of the constant stretching on the ankle. After a VERY PAINFUL and LONG 4 months after surgery, I, finally no longer have pain in my right ankle. But, now, even though I haven’t wore the Shape-Ups in awhile, my left ankle/achilles, feels permanently pulled, and somewhat achy. Hopefully this goes away with time …. I can’t even stand the thought of having to have another surgery. OMG, I would die! Anyway, whatever you do, NEVER WEAR SHAPE-UPS!!

    So how many of you who are complaining about the shoes have done a single thing to contribute to the class action against Skechers other than want some money? Few if any I would bet. Those mentioning other brands with similar claims as skechers don’t mention anything you have done to gain resolution. Instead of just propping up your sore feet and complaining do something or move on.

    I googled ‘shape ups and pinched nerve’ and this thread came up, i have terrible lower back problems and a shooting painful nerve pain down my legs and sometimes my arms. Ive been wearing this shape ups for about 2 months! Never again ! I liked how they made me an extra 2 inches taller! :/

    I think that some people are getting confused between Reebok and Sketchers. Reebok checks have been mailed, and if you have not gotten one by now, you won’t….Sketchers final fairness hearing has not been done yet, therefore it will be at least 3 months at minimum before you see any checks from Sketchers.

    My tendons in the back of my ankles are so screwed up from wearing my sketchers, which I do not wear now, Im not sure if I will Ever be able to walk normal again. I was perfectly fine until I started wearing them every day to work for a few months, now I can hardly walk normal and many days I cant. Getting up in the morning is absolute hell!

    amy I have no reason to lie. I received my payment and it was sent to the bank. I had a claim over $200 dollars that required documentation, thank you very much. I live in Illinois and I received the payment about 3 weeks ago. I told you the amount and once again it’s looks like a little post card. I don’t have any Reebok settlement so that’s not what I received. I don’t make it a practice of filing for frivilous settlements everywhere… this was the only one I was expecting and received.

    Carla maybe your settlement hasn’t been maile but i received mine. I was in the over $200 portion of the class. U know the one for people who actually bought the product and produced receipts. Ask at the 800 number when they sent those checks out and you will see that it was sent some time ago.

    3 years ago I bought 2 pair of the shape ups believing in the promise that they would make my back and legs more fit. After only wearing them a few times I had acute pain in my right hip. My doctor said it is my SI joint. I asked if it could be from the shoes only to be assured it isn’t likely. No matter what the drs do nothing improves the pain. Unreal that such a stupid thing has such an impact.

    This is a second Sketchers class action. The first one closed and checks were mailed out in TX in August. It was on the local news. The checks did come on a post card. This is a second class action. Checks won’t be mailed until after the claim deadline which is 4/18/2013!

    I wore the ShapeUps for about 1 month. I had trouble wearing them during my normal walking routine and when I fell wearing them, I quit wearing them immediately. I ended up with scraped up knees and my legs in pain. They now sit in my closet.

    The day I put them on I almost fell backwards fiance caught me at shoe store – the clerk just laughed – ended up going to chiropractor for 3 months who told me to stop wearing them which I had bought the shape ups for 105.00 at Shoe Carnival in Taylor MI. I got good at wearing them without falling and was even able to run in them but as far as shaping me up = totally false statement. I no longer have me receipt so doubt I would get a penny.

I already have a nice bottom, they have not made any differne in my rear, they do not tone any thing @ least not for my family, and friendsthat have purchased them.     Disabled people wear shoes too and given they are disabled and unable to do things the average person can do, anything that helps them maintain some level of muscle tone is important. They were blindly fooled by the promise of muscle fitness more than the average person. Plus some may have purchased shoes for gifts too and as such are entitled to this just as much as the next person. Plus just because someone comments here on ANY comment board does not necessarily mean they are actually part of the suit aka a claimant….

    If these shoes hurt your feet, you’re probably too fat. Try Jenny Craig first. Once you lose a couple hundred pounds ,then try wearing the shoes. Either way if you’re ugly, these shoes won’t change a thing. In other words, if you look like someone held you upside down and filled you with Cottage Cheese, that’s the problem….look in the mirror at “the big picture”.

    I got my Skechers refund about 2 weeks ago for $200.00. Bought some better shoes for half the price. I can’t imagine why everybody hasn’t gotten theirs yet. My wife got her’s a few days later for $275.00. Most of you must be looking at the wrong website or you THOUGHT you filed a claim. For the person that moved. You are just out of luck because the USPS only forwards mail for 90 days then it goes return to sender.

    I purchased these shoes from the mall and fell , I immediately took them back. I filed the claim over a year ago. I have not heard anything back.
    These shoes are in resale shops in the Tarrant county area and nobody will buy them there either.That is pretty sad. Sketchers are normally a good brand.

    I also wanted a pair as soon as I saw them since I am a Sketchers fan anyway! But much to my surprise I went to lean down to kiss my baby in the walker and litterly fell(rolled) on top of them There were a few more incidents before I realized the shoes should of had a warning label on them! I did report it to Sketchers back then and they said they would direct it to the proper dept. A year later I saw the ad on TV!!!!

    The time to file has not closed yet, plus the time period to file an appeal after judgment has been rendered has to pass as well ( usually 60 days) before any disbursement of claim funds can be made. Plus I am sure there will be a verification phase as well.

    It’s fine to go through Top Class Actions to file, but once the settlement date is closed, where do we see the status to keep us up to date on progress of payments being issued, or what if we don’t receive the payment filed for? Don’t easily see on the site where to view ongoing status until the thing is actually closed, meaning all payouts have been made.

    Claims will not be paid until the settlement is given final approval by the Court. Final approval won’t happen until end of March, 2013 at the earliest. Then it will take a number of months to review claims and get checks into the mail. Payment may be further delayed by appeals. It will likely be late summer before checks are issued.     Okay it is true..We do have a date issued for the settlement checks.

    The Court granted final approval on May 13, 2013. This is the Final Settlement Date. Checks will be issued to valid claims by July 13, 2013.

    $40 million for 520K in settlements. That equates to $76.92 per person. Assuming that 100 percent of these claims are valid, that means likely the majority of people will get much less than they likely claimed.

    As for the date…since most claimants didn’t actually BUY these shoes like I did and may cost me money I spent and got taken on, the fact that some are complaining about a date of checks being sent is the height of irony IMHO.

    $40 million for 510K in settlements. That equates to $78.43 per person. Assuming that 100 percent of these claims are valid, that means likely the majority of people will get much less than they likely claimed.

    As for the date, it appears the money is going out, even updated the website. But since most claimants didn’t actually BUY these shoes like I did and may cost me money I spent and got taken on, the fact that some are complaining about a date of checks being sent is the height of irony IMHO.

    Well I just contacted them and I was told my claim was denied because the FTC said I had made a previous claim with Reebok!!! So what!! I mailed in credit card statement with the actual name of the Skechers shoe and my claim was under $200 and it gets declined because I made a claim in the Reebok settlement?? What a bunch of bull crap! He said well, your $162 claim was denied and there is nothing you can do! I could maybe understand if I hadn’t sent in my proof of purchase using the cc statement. I thought we were suppose to get a denial letter? Good luck to everyone else, you’re going to need it!

    received my check yesterday for 141.00! here’s what I find rather curious… I also had a class action settlement from the DeBeers fiasco. now that settlement was 240 million dollars with about the same amount of claims filed. my payment for that (mind you over 10,000 bucks in diamonds) 121.00! so I spend 10,000 on diamonds and get 121 dollars out of 240 million and get 141 dollars for 200 worth of shoes out of 40 million! think I smell a crook here!!

    This is total **** i called about my check today and they said my claim was not accepted, because of an audit by the FTC found i am enrolled in a few class action lawsuits…. not only did i buy these shoes for my wife i bought them for my daughters, i have a big family to this date i have only claimed walnuts and rice krispie class action and have gotten a whopping 10 bucks back. i will never buy from this company again . someone is keeping the money.

    Haven’t received my check yet as of today’s mail. My sister across town received hers yesterday. Tried calling the number & it has been disconnected. I will wait a few more days then will attempt to file suit against the settlement administrator for not doing what they are supposed to do.     No check yet here in NC either, Bob. I never received a letter in the mail asking for proof and I only submitted for one pair which I had the receipt for. Not sure what is going on? I submitted a claim in the Reebok settlement (again for 1 pair of shoes that I had a receipt for) so maybe that is why.

    Just spoke to someone at 866 number (you have to select the check problem option to get a person. I also got “denied by FTC” because I’ve been a member of another class in last four years. I did not do Reebox, because I didn’t buy those. I did buy like 6 pairs of Skechers and 4 New Balance, though. I also bought a boatload of Diamond Walnuts, so claimed that and a baby monitor. I actually bought this stuff that is being sued over, and get nothing because more than one company has bad business practices and I try to protect my rights.

    Lovely. So, if you haven’t gotten your check yet and you’ve filed for any other class action in last 4-5 years, don’t count on this one, folks. Lawyers are trying to pad their own pockets at consumer expense.

    I also received a denial letter for Walborn. I received a check on the Reebok, but not the Skechers. I didn’t call the # because it seems like it would be a lost cause. They’re not going to correct anything. I thought the FTC was FOR the consumers, not against. I don’t keep receipts. I buy too much stuff to do that, especially as far back as these suits go. When we submit a claim and it says NO PROOF OF PURCHASE REQUIRED, and then the claim gets denied, that makes NO SENSE! They have no proof that WE DIDN’T BUY IT!!!

I knew that they could not deny the people who submitted claims that were less than 200.00 no matter how many claims you filed.

    FTC has nothing to do with rejection of claims.Claim administrators have database to see which name and address are filing multiple claims.They are blaming FTC. By rejecting muti filers they think they are avoiding multi filers. In case of FTC vs walgreen they found half a million multi filers claims and rejected them even for 30 dollars.Skecher s they rejected 250,000 claims for same reason and more. DATA BASE is doing the tricks for them. Hope they get common sense before they get sued because what they are doing is exactly wrong manipulating peoples personal datas and abusing them .Now you know why we need snowdens.

    This is what settlement administrators are doing wheather is Rust, BMC,BMB, KCC etc They all do not answer even paper claims for people on their list meaning they will throw your claim un acceptable file.Only because you have filed few different claims BUT thats against law, AN american can file as many claims as they want if they have been damaged by products they used or bought. SOME ATTORNEYS NEED to get TOGETHER and sue these administrators for being unloyal to people UNLESS if ATTORNEYS are behind this and doing this. Keep your receipt for x number of years, we may have a lawsuit against us, 3. What’s your name?, 4. Can we take a picture of your wearing these terrible a** shoes., and 5.     If your family name with address is on their database you are on their black targeted list. They will not approve your claim. will put it a side. They will not inform you at all.If you call GCG or Rust any admin they will send your message to headquarter in case of GCG in seattle and someone so called project leader will ask a low profile woman to call you saying your claim was not approved with B.S reasons.If you submitted receipts to prove you will be told it was inadequete and thus you are not qualified. Basically they are harrasing you and telling you will not be eligible BECAUSE you are on their targeted list. You can send receipts whats required but you will not get a positive answer period. Validate what my swang? when there is no proof of purchase required for buying 10 cups of yogurt 5 years ago or shoes or mouthwash. Just reject. We hope this attorneys realize and fire GCG from this handling .Rust is doing same too.

    Spoke to representative today. Now they say they can not find my resend receipts which earlier they said they have it and was attached in my claim and will take at least 1 to 2 months to process .My claim was tageed like many other people so they are not going to even consider .Just rejection on anything and everything I file with Garden city Group . seems someone went in claim and removed my receipts and kept claim rejected. I am sick of this low life city Group discrimination

    sorry Phil, I didn’t want to post my real email here. Anyway, I wanted to tell you that I am in the same situation as you.

    I am targeted by GCG & FTC. Not sure about Rust. I have explained to GCG that we are a very large family here. We do one claim per person and getting blacklisted. I have not received any of the last 6 GCG class actions.

    I can’t due anything to get of their target list. And the claims were for no receipt requested. It’s so wrong!

    I have a complaint. Supposedly I was sent a check in June 2013 as with all the other checks. I didn’t receive it. I called, I had to wait until the end of August before they would do anything. I was told to write a letter stating that I did not receive the check. I did write the letter. NOTHING EVER CAME. I wrote another letter, went to the post office, paid for tracking etc. They received my letter and still NOTHING. So for me, what a joke that was. I guess the corporation handling the settlement wanted to keep my money! Not a happy camper.

    I did not receive my refund from skechers. Can you tell me why. I did my claim on the 1st of June 2012.

    @Toy and @Phil. we resubmitted receipts like the letter or e mail said.It has been almost 3 months, No answer. No reply in e mail either. Called them 9 times. This is handled by GCG or Rust . BMC group is a fake face name. They stole our receipts and claims are still invalid and tagged so all last 12 months claims filed have been rejected or hold without any explanations. I bet they are sitting on 25 to 30 million dollars of leftover money from 40 million paid out by skechers and someone will eat it.
