A class action settlement has been reached in an unpaid overtime class action lawsuit against Convergys Corp. If you are a current or former hourly Remote Agent for Convergys Corp., you may be entitled to a compensation via the Convergys unpaid overtime class action settlement fund.
Plaintiffs Carla Matthews, Lisa Worrills and Gary Cosby, all current or former Convergys employees, filed this unpaid overtime class action lawsuit against Convergys Corporation and Convergys Customer Management Group Inc. in North Carolina federal court on behalf of themselves and a Class of similarly situated hourly Convergys employees who allegedly had their rights employee rights violated.
According to this Convergys class action lawsuit, the plaintiffs allege Convergys violated the Fair Labor Standards Act (FLSA) by neglecting to pay Remote Agent employees for all hours worked. This includes overtime hours, performing the pre-shift, post-shift, and pre- and post-meal break preparatory activities, as well as mid-shift technical downtime issues.
Convergys denies all allegations brought against them in this unpaid overtime class action lawsuit. However, the defending company has agreed to this Convergys class action settlement in order to avoid the uncertainty of further litigation and court costs.
Convergys has agreed to pay $4.5 million in total to compensate all eligible claimants, pay for Settlement Administration costs, plaintiffs’ attorneys’ fees and court costs, and to provide an incentive award to the named plaintiffs who served as Class Representatives.
Who’s Eligible
Class Members of this Convergys unpaid overtime class action are defined as all current and former hourly customer service related employees — such as agents, customer service representatives, problem resolution representatives — and all other Convergys Corp. hourly employees in similar Remote Agent positions, who communicated with Convergys Corp. customers and potential customers from May 16, 2011 through Aug. 28, 2015.
Excluded from the Class are Telecommute Agents.
Potential Award
Varies. The amount each claimant receives depends on the total amount of time worked, and the number of timely and valid claims filed.
Benefits for Class Members will be no less than $65 and no more than $10,000.
Proof of Purchase
Complete and mail or fax a Claim Form and Release, along with a W-4 and W-9 Form to the Matthews v. Convergys Settlement Administrator no later than Nov. 2, 2015.
If you have not received a Claim Form, you can request one by calling the Settlement Administrator or writing to them at the address provided.

I worked for convergys for 16 years I had the attorneys phone number however lost my phone I’m in Texas please help
My daughter was never even contacted regarding this. I started working for Convergys in 2017. They are now Concentrix and they are still doing the same practice. It takes 5-10 minutes to log in..just to get to the time clock..and you can’t clock in until 5 before your shift. This needs to be opened.
I have not received any updates in regards to the lawsuit nor have I been paid yet. Still wanting to know what is going on and why is it taking so long? I need answers and hopefully sooner than later.
I have called all numbers to lawyers and have yet to speak to one person. I sent in all paperwork and no check. I still have help desk ticket numbers. Which they never asked for so how will the adjusters know how much im owed.
Unless you got your claim form. In by the deadline there isn’t much you can do except maybe speak to the court. I’d call the attorneys for the plantiff . They haven’t ever called me back I’ve called them a dozen times. Nor have I ever gotten paid and not only was I shorted more than 4 thousand dollars in wages, I paid more than ten thousand into my 401k. And they screwed me out of it.
I received my settlement check and was underwhelmed…it also did not include anything in reference to help desk tickets and time I was not paid. Any number you call is a recording. I would like to see how finds were dispersed after the lawyers got their 1.8 million. Others I’ve worked with received laughable amounts as well for the length of time they worked.
Do you really think the Lawyers care about us. The longer they keep the money the more interest they can have for their bonus . That why there’s no contact. Just a thought.
I called last month but was not able to speak to anyone because the person they refered me to was not available. I figured I would just wait it out. I guess I can keep waiting.
