PharMerica class action settlement

PharMerica Corporation has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by sending fax advertisements promoting its “symposia/exhibition series.” If you were sent one or more of these PharMerica symposia faxes between Oct 29, 2009 and Nov. 5, 2013, you may be eligible to claim up to $300 per fax from the class action settlement.

According to the fax spam class action lawsuit, PharMerica sent plaintiff Pines Nursing Home 109 symposia/exhibition faxes between Oct. 29, 2009 and Nov. 5, 2013. Pines Nursing Home alleges this conduct is a violation of the TCPA, which regulates the transmission of advertisements via fax. Under federal law, recipients of junk fax communications are entitled to damages of $500 per fax transmissions that are found to violate the TCPA.

PharMerica has denied all wrongdoing but agreed to settle the fax spam class action lawsuit to avoid the expense and uncertainty of trial. The PharMerica TCPA class action settlement was preliminarily approved on June 26, 2015. Under the terms of the junk fax class action settlement, PharMerica has agreed to pay up to $300 for each fax it sent that allegedly violated the TCPA.

Who’s Eligible

Class Members of the PharMerica fax spam settlement include all persons and entities to whose fax number(s) PharMerica successfully sent one or more “symposia/exhibition series” faxes between Oct. 29, 2009 and Nov. 5, 2013.

Potential Award

$156.50 – $300 per fax. The amount that will be distributed per fax depends on how many Class Members file valid claims and how much of the settlement fund remains after settlement costs have been paid.

NOTE: In order to receive payment from the TCPA class action settlement, the fax must have been sent to a fax number that is contained in the records produced during litigation. Only the individual or entity which actually subscribes to the fax number is eligible to receive payment.

    Every denial letter sent costs 48 cents postage plus 25 cents processing equal 73 cents decreasing the amount that deserving class members should get. Lesson: Please only apply to these if you are TRULY a class member!!
