A class action settlement has been reached in a debt collection class action lawsuit against The Money Store, TMS Mortgage Inc., and HomEq Servicing Corp., resolving claims that these companies violated the Fair Debt Collection Practices Act (FDCPA). If you took out a loan that was serviced by the Money Store or the other named defendants, and received a breach letter from the law firm of Moss Codilis Stawiarski Morris Schneider & Prior LLP (“Moss Codilis”), on or after June 22, 2000, then you may be entitled to a portion of the settlement fund.
Plaintiffs Lori Jo Vincent, Ruth Ann Gutierrez and Linda and John Garrido filed this FDCPA class action lawsuit in April 24, 2003, alleging that breach letters sent to borrowers from the Moss Codilis law firm violated the FDCPA.
The defending lenders in this Money Store class action lawsuit deny all allegations, wrongdoing and liability, but have agreed to settle in order to avoid the uncertainty of further litigation and increasing court costs.
According to this FDCPA class action settlement, the Money Store and the other defending companies have agreed to pay $450,000 in order to establish a Money Store class action settlement fund, in addition to paying $50,000 in plaintiffs’ attorney’s fees.
$1,000 will be distributed to the named plaintiffs for acting as Class Representatives, and the remaining $449,000 will be distributed equally among eligible Class Members who do not opt out of the Money Store FDCPA class action settlement.
Who’s Eligible
Class Members of this FDCPA class action settlement include all borrowers of loans serviced by the Money Store or the other defendants who on or after June 22, 2000, received breach letters from the Moss Codilis law firm.
In order to avoid doubt, a Class list consisting of 12,204 individuals was provided by the plaintiffs on June 4 of this year. Henceforth, the Class shall only consist of these named individuals.
Potential Award
Varies. The $449,000 settlement fund will be divided among the settling Class Members who chose not to opt-out of the Money Store FDCPA class action settlement.

The appeals court affirmed the settlement approval in July 2016. Unfortunately, the settlement website is no longer active. You can try contacting the settlement administrator for an update on claim payment status. There is a PO Box and an email address available.
