Details: Summer Infant, Inc. and Babies “R” Us have agreed to pay a $940,000 class action lawsuit settlement regarding Summer Infant’s analog video baby monitors, whose broadcast signals can be viewed outside consumers’ homes on other baby monitors up to 350 feet away. Consumers who purchased a Summer Infant Video Baby Monitor can file a claim to receive a cash refund from the proposed class action lawsuit settlement.

The Summer Infant Video Baby Monitor settlement will resolve a 2009 class action lawsuit, entitled Alissa Jamison, et al. v. Summer Infant, et al., filed by two mothers who were shocked to discover that their Video Monitors were broadcasting to and receiving the sights and sounds of their baby’s room and the rooms of neighboring babies.

The mothers sued Summer Infant and Toys “R” Us (d/b/a Babies “R” Us), alleging in the class action lawsuit that both companies failed to advise consumers that certain non-digital Summer Infant Video Baby Monitors were unencrypted, which left their broadcast signals susceptible to being received and viewed on other video monitors. Summer Infant and Babies “R” Us deny liability, but have agreed to class action lawsuit settlement to avoid ongoing litigation.

Under the Summer Infant class action lawsuit settlement, consumers who purchased a Summer Infant Video Baby Monitor between December 9, 2004 and the date of the Preliminary Approval Order can file a claim form to receive a cash payment share of the $940,000 class action settlement fund, up to 40% of the Manufacturers’ Suggested Retail Price (“MSRP”). The recovery per claimant will depend upon how many claims are filed.

Claim forms must be received by April 20, 2012 to be valid. You can download a claim form at www.VideoBabyMonitorSettlement.com and mail it to the address provided above, or submit it online.

In addition to the cash payments, Summer Infant has also agreed to modify its product descriptions and disclose on all advertising and video monitor packaging, as well as on its website, that the broadcast signals of its non-digital video baby monitors are susceptible to reception by other monitors.

    I doubt any money will be issued in this case. The attorney’s aren’t returning my calls asking for an update.
