A Texas woman recently filed an Unum bad faith insurance lawsuit in an attempt to gain the long term disability benefits she has allegedly been unjustly denied.
Unum Life Insurance Company is the largest disability insurance company in the United States, but it has been faced with a growing number of Unum bad faith insurance lawsuits.
These disability insurance lawsuits allege that Unum caused hundreds of thousands of people with legitimate disability insurance claims to be denied insurance for no reason other than to boost the company’s profit.
The plaintiff Melissa G. filed this Unum bad faith insurance lawsuit because she was allegedly denied long term disability benefits by Unum, despite fitting the insurance company’s requirements to be considered disabled.
Melissa’s employer provided long term disability benefits, and though the plaintiff suffered from a medical condition that prevents her from performing the duties of her occupation, her disability benefit claim was denied. Melissa appealed this decision, but was denied once again.
The Unum lawsuit alleges a conflict of interest with Unum acting as both the determiner of claims and the payer of claims, given that this could potentially offer Unum and other insurance providers the power to unfairly deny legitimate insurance claims.
Melissa ’s Unum bad faith insurance lawsuit claims that she is entitled to the LTD benefits guaranteed under her policy. She claims in the lawsuit that Unum’s claim denial was both “arbitrary and capricious,” and seeks the benefits she has been denied.
The Texas woman alleges that Unum’s denial letter failed to provide a reason that Melissa fell short of requirements, and did not identify anything that she could improve to meet those requirements.
