A settlement has been proposed in a class action lawsuit that alleges OfficeMax North America Inc. requested and recorded personal ZIP codes in conjunction with credit card transactions at California OfficeMax retail stores. If you used a personal credit card to make a purchase at a California OfficeMax retail store between March 1, 2010 and Feb. 22, 2011, you could be eligible to receive an OfficeMax merchandise voucher worth $10.
Who’s Eligible
Class Members of the OfficeMax ZIP code settlement include all persons who used a consumer credit card to make a purchase at an OfficeMax retail store located in California between March 1, 2010 and Feb. 22, 2011, and whose personal ZIP code was requested and recorded in conjunction with the consumer credit card transaction.
Excluded from the class action settlement are persons from whom OfficeMax requested and recorded a ZIP code for a special purpose incidental, but related to, the credit card transaction, such as for shipping, servicing, special orders, installation, customer loyalty program applications and OfficeMax-branded credit card applications.
Potential Award
$5-$10 Merchandise Voucher. Class Members who submit timely and valid Claim Form will be eligible to receive a single OfficeMax Merchandise Voucher worth $10. Under the terms of the class action settlement, OfficeMax also agrees to distribute 120,000 merchandise vouchers worth $5 to customers who make purchases in California OfficeMax retail stores. Claim Forms must be submitted online or by mail, postmarked no later than Feb. 10, 2014.
Proof of Purchase
You must declare under the penalty of perjury that you used a personal (not business) credit card to make a purchase at an OfficeMax retail store located in California during the Class Period and provided your personal ZIP code in response to a request by an OfficeMax cashier during the transaction. You must also provide a portion of your credit card number, the type of credit card you used, and the location of the California OfficeMax store from which you purchased the merchandise.
Alternatively, you can submit a copy of the sales receipt or a copy of your credit card statement (with all but the last four digits of your credit card number redacted) reflecting your purchase transaction at a California OfficeMax location during the Class Period.
The information provided in your Claim Form and your membership in the Class will be subject to verification by the Settlement Administrator.

Case Summary
The OfficeMax ZIP code settlement will resolve a class action lawsuit (Dardarian v. OfficeMax North America Inc.) that alleges OfficeMax violated California law by requesting and recording personal identification information, including ZIP codes, from customers who purchased merchandise from a California OfficeMax retail store using a personal credit card.
OfficeMax denies any wrongdoing, but has agreed to provide merchandise vouchers to consumers under a revised class action settlement that was preliminarily approved on Nov. 14, 2013.
