California nursing home operator Lifehouse Healthservices LLC and its affiliates have reached a class action settlement over claims that they failed to meet California’s nurse staffing requirements. If you or your loved one were a resident of one of the assisted living facilities listed below between 2008 and 2013, you may qualify to claim a cash award from the class action settlement.
Who’s Eligible
Resident Class Members include all persons who resided in one or more of the California Facilities listed below at any time between Dec. 19, 2008 and Nov. 1, 2013. The settlement also includes Successor Class Members, who are all persons named as a beneficiary in a will or living trust of a deceased Resident Class Member, or if there was no will or living trust and depending on the circumstances, may be the surviving spouse, domestic partner, child, parent, sibling, grandchild, grandparent or other relative of a deceased Resident Class Member. Resident Class Members include “Current Residents” (meaning persons who resided in a Facility on the Class Notice Date) and “Former Residents.”

Maclay Healthcare Center
Parkview Healthcare Center
Riverside Healthcare Center

Potential Award
Varies depending on the number of days during the resident’s stay multiplied by an Estimated Violation Rate of 12% multiplied by a Per Violation Amount of $10. For example, if a Class Member (or his/her predecessor) resided in a listed Facility for 100 days, the payment owed to that Class Member would be $120 (100 days x 12% x $10 = $120)
The amount of money available under the terms of the class action settlement may be more or less, depending on the funds available after calculating the Cash Payments owed to all Eligible Class Members.
Proof of Purchase
Current residents of a LifeHouse assisted living facility do not need to submit proof of purchase or submit a Claim Form — they will automatically receive payment if the class action settlement is approved.
Successors of a deceased resident will need to provide the resident’s Social Security Number of Taxpayer Identification Number with a Claim Form.

Case Summary
The LifeHouse assisted living settlement resolves a class action lawsuit (Dalao v. LifeHouse Holdings LLC) that alleges the defendants LifeHouse Health Services LLC, LifeHouse Holdings LLC and Westport Capital Partners LLC failed to meet California’s nurse staffing requirements during the Class Period. Defendants deny the allegations but have agreed to resolve the litigation by creating a $4.4 million class action settlement fund to pay out Class Members.
In addition to offering cash payments to Class Members, LifeHouse must also meet a court-ordered injunction requiring the facility to comply with applicable nurse staffing requirements. In addition, LifeHouse must staff its assisted living facilities at levels at or above 3.3 Nursing Hours Per Patient Day (NHPPD) in the first year the Injunction is effective, and at or above 3.4 NHPPD in the second year the Injunction is effective. The Injunction will become effective Jan. 1, 2014, and will remain in place for two years thereafter. A court-approved Monitor will oversee compliance with the injunction.

My partner resides in the Castro Valley facility, and has since March of 2009. (They have since changed names). We were aware of the lawsuit, but no check was ever mailed. Aside from the theft, things are okay, but there are still issues. Like the a/c not working on the hottest week of the year. Does anyone know if it still the same owners under a new name?

My mother stayed at the life house facility twice and passed away. I am a surviving relative and aware of the lawsuit.
I hope this class action is taken up in other states. My late mother suffered at one of the so-called “premiere” LifeHouse assisted living facilities. All smoke and mirrors with them; no regard for elders or proper staffing.
