Popular Class Action Settlements Pay Out in Early 2015
It’s only a little more than a month into the new year, but 2015 is already shaping up to be a big one for class action settlement payouts. Top Class Actions viewers are reporting they’ve received checks from popular class action settlements involving FitFlop, Emergen-C, Big 5 Sporting Goods and Arctic Glacier/Reddy Ice. Report: Morning Sickness Drug Linked to Birth Defects Zofran (ondansetron) is a powerful anti-nausea drug that has been approved to treat nausea from chemotherapy, radiation therapy and anesthesia, though it is sometimes prescribed to treat morning sickness during pregnancy. New research, however, links Zofran to an increased risk of birth defects. If you or a loved one took Zofran while pregnant and had a baby with a birth defect, you may have a legal claim.

 

UAW to Pay $355M in Health Plan Class Action Settlement  – United Auto Workers (UAW) has agreed to pay $355 million to settle a class action lawsuit over allegations the labor union made unauthorized changes to the employees’ health plan in violation of collective bargaining agreements. Under the terms of the class action settlement, UAW will fund a new voluntary employees’ beneficiary association trust (VEBA) that will provide benefits to eligible Class Members.

 

Herbal Supplements False Advertising Class Action Lawsuit InvestigationThe New York State Attorney General’s Office has accused GNC, Target, Walgreens and Wal-Mart of selling store-brand herbal supplements that do not contain any of the herbs listed on their labels. Many of these supplements reportedly contain fillers and other ingredients that may pose a hazard for people with allergies. If you have purchased certain store-brand herbal supplements from one of these retailers, you may have a legal claim. Find out if you qualify now!

 

Arm & Hammer ‘Natural’ Deodorant Settlement Gets Initial OK  – A New Jersey federal judge has preliminarily approved a class action settlement over allegations the labeling, advertising and marketing of Arm & Hammer Essentials “Natural Deodorant” was misleading because not all of the deodorant’s ingredients were natural. Under the terms of the false advertising class action settlement, consumers who purchased the allegedly mislabeled deodorant may be eligible for a refund.

 

Eliquis Study Finds One-Third Of Patients On Wrong DoseResearchers have found that as many as one-third of patients on newer-generation blood thinners like Eliquis are taking the wrong dose. Specifically, the researchers found that many doctors who prescribe Eliquis do not take kidney problems into account. A smaller dose of Eliquis will have a greater effect on patients with impaired kidney function, while a larger dose may put them at an increased risk of uncontrollable bleeding. If you or a loved one took Eliquis and suffered from uncontrollable internal bleeding, gastrointestinal bleeding, hemorrhaging, kidney bleeding or death, you may have a legal claim.

 

Judge Approves LinkedIn $1.25M Class Action Settlement – A $1.25 million class action settlement over a data breach that affected LinkedIn users in 2012 was granted preliminary approval by a California federal judge. LinkedIn users who purchased premium memberships may be eligible for a cash payment from the LinkedIn class action settlement. Additionally, LinkedIn has agreed to add additional security protections to more effectively safeguard user data.

 

FDA: Zithromax SJS Risk Downplayed by Pfizer Stevens Johnson Syndrome is a rare but life-threatening drug reaction. The U.S. Food and Drug Administration (FDA) has warned Pfizer, the manufacturer of Zithromax, that it hasn’t done enough to warn the public about the risk of Zithromax SJS. According to a warning letter the FDA sent to Pfizer in 2012, the advertising materials for Zithromax overpromoted the drug and downplayed the risks of SJS, heart attack and liver failure associated with Zithromax.

 

Judge Won’t Budge on Move Free Joint Health SettlementA California federal judge denied plaintiffs’ motion to put off the approval of a $5 million class action settlement over the allegedly false advertising of Schiff’s Move Free joint health supplement after a similar settlement was recently overturned on appeal. However, the judge will allow the parties to renegotiate the terms of the class action settlement and submit amendments to the deal.

 

Depo-Testosterone Lawsuit Joins Testosterone MDLThe testosterone injection Depo-Testosterone caused a man with no history of blood clots or heart problems to suffer a heart attack, according to a testosterone product lawsuit that was recently filed into multidistrict litigation (MDL). If you or someone you know suffered a heart attack, blood clot, or other injury from using a testosterone product, you may qualify to join a class action lawsuit investigation and pursue compensation.

Update from the President of TCA

Good morning fantastic Top Class Actions viewers! As you noticed at the top of the newsletter, settlements are already paying out in 2015! That’s great! Keep submitting those claims for class actions you qualify for and you’ll see checks roll in regularly! We’ll keep reporting on these payments so you know whether to call the settlement administrator for the status of YOUR check if you don’t get it. You have to move fast on these. I get calls and emails from claimants every week who lost a check and found it a year later, or who never received a check and are hoping for one. If you don’t get your check call the settlement administrator! These class actions typically shut down within a few months of paying out so if you wait months, there will be no one to call, and you will be out that cash. Remember, we’re not settlement administrators so we can’t advise you on the status of your claim. You’ll have to call the settlement administrator for that information (and we always list their information when we have it in the Open Settlements section, or if it’s closed and paying out, in the Closed Settlements section). You can always search for the settlement you’re trying to track down by using the Search Box on the top right hand corner of every page (look for the magnifying glass).

 

On the home front we are ROASTING! It’s in the low 80s today! For the first time in months my youngest daughter Aubrey was SWEATING when I picked her up from preschool today. She was having so much fun running around on the playground she didn’t mind a bit, but it’s a reminder about how warm it will be here in a few months. Thankfully it’s still cooling down nicely in the evenings and the heat doesn’t do much to slow down my girls. They’re still up for riding bikes, jumping on the trampoline (or bounce-o-lean as Aubrey calls it) and riding their scooters. It’s awesome they have so much energy. It keeps me moving!
